Westlake TCPA settlement

A proposed settlement has been reached in a class action lawsuit alleging Westlake Services LLC d/b/a Westlake Financial Services used an automatic telephone dialing system and/or a prerecorded or artificial voice to call cell phones without the prior express consent of the person called, in violation of the Telephone Consumer Protection Act (TCPA).

If you received a call on your cell phone from Westlake or on behalf of Westlake that used an automatic telephone dialing system or prerecorded voice between Jan. 11, 2012 and Nov. 7, 2013, you may be entitled to compensation from the class action settlement.

Westlake has agreed to create a $10 million settlement fund to resolve the TCPA class action lawsuit, to be distributed on a pro rata basis to eligible claimants.

If approved, this Westlake Financial class action settlement will resolve allegations that Westlake violated the TCPA by making calls to consumers’ cell phones using an automatic telephone dialing system, prerecorded or artificial voice without the consumers’ prior express consent. Westlake denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty associated with ongoing litigation.

Class Members who wish to exclude themselves from or object to the Westlake TCPA settlement must do so no later than June 21, 2016.

Who’s Eligible

Class Members of the Westlake TCPA settlement include: “All persons to whom Westlake, its agents and/or its independent contractors between January 11, 2012, and November 7, 2013 placed a telephone call using an automatic telephone dialing system or an artificial or prerecorded voice to the person’s cellular telephone in connection with the confirmation of a loan applicant’s references.”

Potential Award

Up to $150.

The $10 million Settlement Fund will be distributed to claimants on a pro rata basis. The actual amount each Class Member receives will depend on the total number of claims filed. However, the maximum amount a claimant can receive from the TCPA class action settlement is $150.

    I received a check for $186.35 back in January 2019, I was very skeptical and waited til I read about the lawsuit on the website that fame with the check. So I guess they screwed me way more??? Or harassed me very ugly???? How is the amount determined? And also any lawyers out there willing to help me out cause now westlake is trying to sue me!

    Lol, I guess we all get $6.54. Of course the majority was absorbed by “attorney fees” It would be funny if it bounced.

    Got a check for $6.54. But mine says “THIS CHECK IS PRINTED WITH THE VERBIAGE “SECURITY DOCUMENT” IN FLUORESCENT INK – DO NOT ACCEPT UNLESS THE WORDS ARE PRESENT”. I do not see these words on the check and nothing in fluorescent ink. Is it safe to deposit this check?

      I normally do not post and play the PILE ON game, but instead of seeing about 90% of you Jones (ing ) over a $6 check, I thought I’d alleviate your anxiety.

      History lesson_ the term Jones- ing comes from a real place in NYC. Named after the GREAT JONES ALLEY, it was a place where addicts went frequently to handle their business. It became so bad that it was a catalyst for the mayor of NYC cleaning that city up of shooting gallery type places, and outdoor sex venues. You can see a picture of it on google,, IT is now a regular ALLEY in NYC, and is fenced in and behind a locked gate.

    These people at Westlake! They keep pushing my “re-issued” check week after week, after week! They say they are having issues with the bank and that is the reason checks keep getting delayed from being mailed out. REALLY!??
