Customers are seeking approval for a $30 million settlement that would resolve multidistrict litigation claiming that IKO Manufacturing’s roof shingles deteriorate earlier than the company says they will.

The proposed settlement was brought forward to an Illinois judge, and would end a nine year multidistrict litigation against IKO Manufacturing.

Under the terms of the IKO roofing class action settlement, homeowners who purchased the allegedly faulty shingles from IKO would receive a five-year extension on their warranty of the products.

They would also be entitled to a cash payment or replacement shingles if their previously purchased shingles fail within the extended warranty.

The shingles company and the consumers began mediation towards a settlement deal in 2016, but were unable to reach an agreement in the first several rounds of negotiations.

Expressing support for the settlement deal, the consumers’ attorneys say that the settlement “saves considerable judicial and attorney time and expense, and achieves signifiant improvements to class members’ warranty claims.”

The shingle quality MDL was brought forward in 2009 by customers who claimed that IKO’s shingles wore out long before their advertised 50 year lifespan.

Allegedly, the products came with an “iron clad” warranty. However, consumers said that the shingles could deteriorate quickly because of water damage.

Additionally, plaintiffs in the IKO roofing class action claimed that the company tried to get out of honoring its warranty by making it difficult for people to file a claim.

Consumers said that when they tried to file a claim saying that only tiles in a section of their roof had deteriorated, they were told by the company that they had to file a claim for the entire roof.

Under the proposed $30 million roofing class action settlement, a consumer who made claims that just a portion of the shingles on their roof were affected would be limited in the claims they could make for compensation.

The MDL once included as many as 19 lawsuits against IKO Manufacturing, but now includes only 15, as of a Sept. 17 report.

In 2014, the consumers and the company disputed Class certification for the shingles warranty MDL in the seventh court. As a result of this effort, the appellate court overturned the district’s judge previous ruling that denied Class certification. Now, the motion for Class certification is still reportedly pending.

On Thursday, the consumers asked the judge to allow the Class to include anyone who owned or previously owned a home or building that had IKO shingles.

This proposed Class would exclude anyone who already brought a lawsuit against the company over the shingle quality and warranty and had already received a verdict.

The Class would also exclude people who had signed a goodwill release of their claims against the company, unless the claims only applied to shingles on a portion of an entire roof.

    Looking at having to replace our roof now, it has only been since 2004 when we moved into our new home. Checking into this situation now. I believe that they were supposed to be 45 year shingles.

    Defective Shingles and Terrible customer service. I paid for a new roof to be installed January of 2016. My Roofer recommend IKO Shingles. The roofer who has been fantastic, installed the IKO Cambridge Shingles and the roofer/installer for the last three YEARS has come out to do repair after repair after repair. The darn things are just not sticking!!!! even my two neighbors across the street mentioned that shortly after the install they started blowing off the roof. Roofer came back out and put them all back on. Nothing but headache after headache. Finally my roofer said these shingles are defective. I have been trying to work with IKO Warranty for the last 6 months and have been met with nothing but resistance. I send in whats requested they ask for MORE information. Be sure to have your tracking number or how convenient they can’t seem to locate the package of shingles and pics. I or my roofer provide that information and again, met with resistance. IKO customer service is terrible. Jump through all the hoops and provide all the information and still get the run around. I will be filing a complaint with my state attorney generals office. And I’ll be sure to tell anyone ( and leave reviews ) who will listen about the defective quality of IKO shingles and the nonexistent customer service. Refused to send a rep out to examine the roof. Screams volumes about the quality of IKO’s products.

    They will send you a packet of what is need to submit the claim. be prepared when you have submitted ALL the information. That they will come back and ask for more.
    Collect receipts, pictures and a ton of pictures, exterior front, back, side top bottom, inside the attic and something with your address on the pic. send that in and they will want close ups, climb up on the roof and get CLOSEUP photos

    Sad that this faulty defective product has made it on so many roofs. Huge cost to consumer. So much for a peace of mind!! Shame on IKO for not standing behind their product..

    We put IKO shingles on our home in September of 2018 the ADHISIVE NEVER ACTIVATED! shingles have been blowing off with the first buff of win and have flapped in the wind. every since!!!! IKO says WE have to find someone to HAND GLUE each shingle on the house, garage and porch!!! and after we have been bagging for help for close to a year they tell us we have 30 days to find someone. EVERY contractor we talk to says they are not interested in that job!! HELP we are old and poor we used every dime we had for that roof. We do not know where to turn!!!

    I have had the same problem with IKO. Have these shingles on a house built in 2014 , and contacted IKO about problem. and they want 8-10 pictures of roof, pics of attic, want you to remove 2 perfectly good shingles and send them to them at your own expense, while all the time, you are having to deal with your roof leak. I finely decide to replace bad shingles my self, because i did not want anymore water damage. The shingle blew up in two different locations because of tar strip not holding. both spots were about 12×12 area. They want you to jump through hoops, when they should have some one come look at it. Wish i new about Class action at the time. this happened May of this year.

    How do we put a claim in against IKO shingles? We had a new roof installation in 2008 with this brand and have had nothing but trouble since then.

    Made a CLAIM SEVERAL YEARS AGO, HAD TO REPLACE THE ROOF., WATING FOR. SOME KIND OF SETTLEMENT . STILL WATING . BEEN SEVERAL YEARS ………

    We installed Iko shingles on our roof 12-15 years ago and they junk…..curling, deteriorating….will need a new roof done. The old roof that was put on when our home was first built were Birdseye and lasted over 35 years. How do we claim restitution?
