citizens of humanity jeansCitizens of Humanity LLC makes the “Boyfriend” jeans and markets them as made entirely in the U.S.A., but the jeans’ fabric, thread, and buttons were made overseas, alleges a putative class action lawsuit against the denim company and Macy’s Inc., which sells and distributes the jeans in California.

Plaintiff Louise Clark alleges in the Citizens of Humanity class action lawsuit that the company, “through an unlawful, unfair and deceptive course of conduct” marketed the jeans as “Made in the U.S.A.” and distributed them through Macy’s, where Clark purchased the jeans in May 2014, and other stores in California, in violation of the Consumers Legal Remedies Act. Clark filed the Macy’s class action lawsuit in California federal court Monday, and seeks to represent all consumers who purchased Citizens of Humanity jeans in California in the last four years.

Clark alleges in the Macy’s class action lawsuit that while Citizens of Humanity jeans contain the “Made in USA” label, the jeans she purchased include fabric and other components that are foreign-made, including fabric, thread, rivets and buttons. Other jeans in the Citizens of Humanity line also include zipper parts that are manufactured outside the U.S.

“Due to defendants’ scheme to defraud the market, members of the general public were fraudulently induced to purchase defendants’ products at inflated prices. Defendants’ scheme to defraud consumers is ongoing and will victimize consumers each and every day until altered by judicial intervention,” the class action lawsuit says.

Clark is seeking damages and is also claiming unjust enrichment.
