Naked Juice class action lawsuitAccording to a recent update by the Settlement Administrator, the appeals to the Naked Juice class action settlement have been resolved, and payments of approved claims are expected to be distributed in the next few months.

The following statement has been posted on www.NakedJuiceClass.com: “The appeals to the settlement have been resolved and the Effective Date of the settlement was April 25, 2014. It is anticipated that payments to approved claims will occur in the Summer of 2014. If you have moved since making a claim before the deadline of December 17, 2013, please update your mailing address by sending an email to info@nakedjuiceclass.com.”

Last summer, Naked Juice Co. agreed to pay $9 million to settle a class action lawsuit that alleged the company falsely advertised some of its juices and smoothies as “all natural” and free of genetically modified ingredients. The Naked Juice class action settlement will award up to $75 to Class Members who submit proof of purchase, or up to $45 without proof of purchase, depending on the number of eligible products purchased.

In December 2013, U.S. District Judge John A. Kronstadt told Class Counsel that they would need to identify the type of work they performed as well as their hours and costs associated with the GMO claims in the class action lawsuit. The same month, an objector filed an appeal of the Naked Juice settlement, postponing the distribution of awards. Details about the Naked Juice settlement appeals were not immediately available.

The first class action lawsuits against Naked Juice were filed in 2011 and consolidated in the Central District of California in 2012 with an amended complaint. The plaintiffs alleged that the “100% Fruit,” “non-GMO,” “All Natural” and “From Concentrate” labels on some of its juice and smoothie products were likely to deceive reasonable consumers. They argued that these products actually contain unnatural and synthetic ingredients, such as ascorbic acid, beta carotene, D-Calcium panthothenate, and others.

Naked Juice has denied the allegations, but agreed to settle the class action lawsuit to avoid the expense and uncertainty of continued litigation. Under the terms of the class action settlement, Naked Juice agreed to offer cash benefits to Class Members and to redesign its labels to remove the alleged misrepresentations.

Now that the appeals have been resolved, the path has been cleared for the class action settlement awards to be distributed.
