More than 200 consumers who have allegedly suffered hair damage or hair loss after using Wen hair products have taken legal action against WEN by Chaz Dean Inc. and marketing company Gunthy-Renker LLC. According to court documents that were recently filed, the parties have agreed to pursue mediation in an attempt to resolve the litigation.

There are currently two WEN hair product class action lawsuits that are pending in federal court. The first (Friedman v. Gunthy-Renker LLC) was filed in 2014 by plaintiff Amy Friedman of Florida. Friedman alleges that she began losing “substantial and abnormal amounts of hair” within two weeks of using the WEN Cleansing Conditioner.

Although Friedman stopped using the WEN hair product, she lost “one quarter to one third of the hair on her head,” according to the class action lawsuit.

Friedman says she purchased the WEN Cleansing Conditioner Sweet Almond Mint basic kit for $29.95 after seeing an advertisement for the product.

A second WEN class action lawsuit was initially filed in March 2015. This class action lawsuit, titled Caryn Collazo v. WEN By Chaz Dean Inc.,  currently has 200 consumers listed as plaintiffs. The plaintiffs allege they experienced hair loss, breakage, and scalp irritation after using WEN products.

The products at issue in the Callazo class action lawsuit include WEN Cleansing Conditioner hair care products of several varieties, including but not limited to: Coconut Mango, Cranberry, Fig, Lavender, Pomegranate, Sweet Almond Mint, and Tea Tree.

According to the WEN hair product class action lawsuits, advertisements for WEN hair care products indicate the product will strengthen users’ hair and leave it looking clean and healthy. The plaintiffs allege these advertisements are misleading and deceive consumers into believing they will experience improvements in the manageability and appearance of their hair.

Gunthy-Renker and WEN deny the allegations set forth in the hair product class action lawsuits and deny making false or misleading statements about the WEN hair products.

Friedman is represented by Neville L. Johnson, Douglas L. Johnson and Jordanna G. Thigpen of Johnson & Johnson LLP; William Anderson, Charles J. LaDuca, and Michael J. Flannery of Cuneo Gilbert & LaDuca LLP; and Brian W. Warwick and Janet R. Varnell of Varnell and Warwick PA.

Collazo is represented by Amy E. Davis of Christiansen Davis LLC and David E. Rosen of Murphy Rosen LLP.

The WEN Cleansing Conditioner Class Action Lawsuits are Amy Friedman, et al. v. Guthy-Renker LLC and WEN By Chaz Dean Inc., Case No. 2:14-cv-06009, in the U.S. District Court for the Central District of California, Western Division, and Caryn Collazo, et al. v. WEN by Chaz Dean Inc., et al., Case No. 2:15-cv-01974-ODW-AGR, in the U.S. District Court for the Central District of California.
