Progressive Projected Sold Adjustments Class Action Lawsuit Overview: 

  • Who: Kiara Siebert filed a class action lawsuit against Progressive Select Insurance Co. 
  • Why: Siebert claims Progressive uses bogus adjustments on valuation reports to undervalue the actual cash value of total loss vehicles
  • Where: The class action lawsuit was filed in Maryland federal court 

Progressive undervalues the actual cash value of total loss vehicles by using valuation reports which apply deceptive adjustments, a new class action lawsuit alleges. 

Plaintiff Kiara Siebert claims Progressive’s evaluator, Mitchell International, applies bogus “projected sold adjustments” in order to lower the cash value of vehicles’ determined to be a total loss. 

“Through Mitchell’s valuation, Defendant systemically thumbs the scale when calculating the ACV of claimants’ loss vehicles,” the Progressive class action alleges. 

Siebert wants to represent a Maryland class of individuals who were insured by Progressive and received compensation for a total loss vehicle that had its actual cash value (ACV) determined by a Mitchell valuation report.

Siebert argues the “projected sold adjustments” applied by Mitchell are “deceptive and unexplained,” and “contrary to the used car industry’s market pricing and inventory management practices.” 

“Defendant has a duty to pay, and represent that they will pay, the ACV of a loss vehicle when adjusting total loss claims,” the Progressive class action lawsuit argues.

Progressive’s Projected Sold Adjustments ‘Not Based In Fact’

Further, Siebert claims the adjustments are “not based in fact” and are “contrary to appraisal standards and methodologies.” 

Siebert argues Progressive is intentionally “manipulating” data used to figure out the ACV of a vehicle determined to be a total loss, only explaining that it is done to “reflect consumer purchasing behavior.” 

“When valuing total loss claims for vehicles, it is improper for an automobile insurance company, such as Progressive, to undervalue and underpay the claims by manipulating the data used to determine the ACV of the vehicles,” the Progressive class action lawsuit says. 

Siebert claims Progressive is guilty of unjust enrichment, breach of contract, and breach of covenant of good faith and fair dealing. 

Plaintiff is demanding a jury trial and requesting declaratory relief along with actual, compensatory, statutory and punitive damages for herself and all class members. 

A similar class action lawsuit was filed against Progressive in October by policyholders claiming the insurer applies “baseless adjustments” to lower the actual cash value of total loss vehicles

    What do I need to submit to be considered a part of this lawsuit. We feel we were scammed by Progressive. Our FMV was 30K and the total cost to repair was 11K and we were told that vehicle is deemed total and they end up giving us fraction of the FMV Cost.

    2014 gmc serria total loss pay out 400.00 four hundred something, vehicle completely totaled my son in coma progressive refused to decuss any detail with me , I am his mom , regardless what they paid him is a joke he paid almost 700.00 monthly on that truck for over a year I dout 400.00 is all he should have been compensated , I’m sit upset about it , the adjusters are a joke they sure want to talk when they want information I was good enough to talk with them when they need information regarding my sons accident but not good enough when they ripped my son off .he paid his insurance he was only 21 at the time be fair he was fair in paying his premiums it’s ridiculous how they settle claims its a dam shame.

    Same thing happened to me in January 2020. My truck was totaled (not my fault) and dealing with the Progressive adjuster was a total nightmare.

    I was hit by another driver. I took my car to an auto body shop and they said it would cost 5200.00 to fix the damage. Progressive is only willing to pay me 978.00 cash payout. This is ridiculous

    I purchased a 2016 ford f350 dually on 8/30/22 I was involved in an accident on 9/1/22 in the state of south carolina a vehicle is not considered a total loss until the cost to repair is equal to or greater then 75% the ACV on the truck is $52,000 the repair cost is $30,000 that is about 60% of the ACV and they still want to total my truck

    Progressive Commercial is using the Mitchell system for all vehicles evidently as I received a lowball offer for my commercial truck damaged by another driver. Progressive thinks paying $40 per hour labor rate is acceptable when it is close to 1/3 most body shops charge. Almost two months since being hit and I have had to go about buying parts to repair my own truck if I want to get back to work with my business. Luckily I have a background in automotive that allows me to make repairs even though it is a charity case costing me labor to do so. Progressive never returns calls and consistently sends messages on a Friday afternoon so they can’t be reached later. I have only talked to two people one time each out of 4 people involved in almost two months. I have rental vehicle coverage with a cap of $1500 yet progressive only paid 30 days for the rental that did not total the cap amount. If you are a business, progressive commercial insurance is not for you as you will go broke waiting for them to take care of your claim and paying for expenses that they leave you hanging with.
