Vail Resorts Wage Settlement Class Action Lawsuit Overview:

After allegations of wage and labor violations, Vail Resorts has reached a preliminary deal worth $13.1 million in a California class action lawsuit.
The class action alleged Vail failed to reimburse employees for equipment and compensate them for time spent in staff training, meetings, meal breaks, traveling up the mountain and properly gearing up for their shifts. A similar complaint has also been filed against Vail in Colorado.
The $13.1 million will “settle all claims” against the resort company, according to court documents. $4.36 million will go toward legal fees right off the bat.
Vail continues to “dispute the accuracy of the claims raised by the plaintiffs,” the Vail Daily reports.
About $8.2M To Be Distributed To Plaintiffs, Class Members
After fees and payments, about $8.2 million will be distributed to the plaintiffs and class members. Most named plaintiffs will each receive $10,000.
Eligible class members are all non-exempt employees who, at any time during the covered period, worked for and were employed by Vail in the United States and worked primarily at one of its resort locations or mountain facilities. The class explicitly excludes corporate or non-resort distribution employees.
The covered period begins in different years depending on the employee’s state of employment:
- Wyoming: Oct. 21, 2010
- Indiana, Ohio, Washington, Minnesota, Vermont, New York, Michigan, Wisconsin, Nevada and Colorado: Oct. 21, 2014
- Missouri: Oct. 21, 2015
- New Hampshire: Oct. 21, 2017
- All others, including California, Pennsylvania and Utah: Oct. 21, 2016
The period extends four years after the start date for California employees or three years after for all other employees.
Each class member will receive an amount that is based on their length and place of employment and the position(s) they worked in.
Vail Resorts Settlement Fine Print
The class action settlement will automatically count eligible class members unless you opt out by filling out a form or not depositing the settlement check.
Any and all employees who cash settlement checks will not be able to bring forward further state or federal complaints against Vail Resorts.
