A federal judge in California on Friday granted final approval to a $10.4 million class action settlement resolving about 24,700 CVS Pharmacy employees’ claims that the company failed to pay them the overtime wages they were due.

Lead plaintiff Sevag Chalian in 2016 had alleged CVS Pharmacy required its pharmacists to complete certain training modules off the clock, a violation of California law. Chalian’s class action lawsuit was consolidated with another similar case in 2020.

Two Classes have been certified: a Pharmacist Settlement Class and a Retail Pharmacy Settlement Class.

The Pharmacist Settlement Class is made up of all hourly, non-exempt retail pharmacists who worked in Regions 65 or 72 in California between July 20, 2012, and the date of the preliminary approval order in October 2020, whose claims are not subject to arbitration and who have not previously released and/or adjudicated the released claims, and whose LEARNet and/or Site Minder data indicates activity when time punch records do not show the retail pharmacist was clocked in.

The Retail Pharmacy Settlement Class includes anyone who is not a member of the Pharmacist Settlement Class who held an hourly, non-exempt position in a CVS retail pharmacy in California between Aug. 3, 2014, and the date of the Preliminary Approval Order who has not previously released and/or adjudicated the released claims.

The maximum settlement amount will be $10,371,346.60, which will be used to pay Class Member awards, attorneys’ fees, settlement administration expenses, and other costs. After other expenses are deducted, about $7,548,124.18 is expected to remain in the net settlement fund for Class Member payments.

Class Members each are expected to receive an average payment of $307.

    The longest time I have worked without a day off was 14 days in a role… I was just told to get over it because there’s nobody else to call into work… which is a lie. Also, we were supposed to get Covid relief if we got sick at work well I didn’t get any of that and instead my manager decided to use on my vacation hours for my Covid pay…

    There has been many issues besides just these that go against so many different laws to my vague knowledge, but I don’t come for money, and I can’t seem to find anybody that wants to help.

    I have insider info on one of the plaintiffs this started in 2016 hopefully this will be finished by end of 2023 based on info on their lawyer. Some other Firm wanted to challenge so it got pushed when it was almost done a few years ago.

    I worked for cvs pharmacy in Tahoe City, CA from 2015-2018 and since I was the only technician, I worked A LOT of overtime. Can I still claim this money?

    Hello I worked for CVS Caremark 2009-2010 in RIDC Park Pennsylvania I was paid my regular wages & I worked a lot of overtime hours but was only paid my regular pay. I don’t know if it’s too late to be compensated but that was not right I still want my pay.

    I worked for CVS in Connecticut from 1999- 2016. I came from having sat and negotiated 5 contracts for a previous facility, so I was pretty savvy about the law. Not only did I put in HOURS upon HOURS of unpaid time- because we could NEVER get caught up, but I was amazed when a LAW was written into the books MANDATING required lunch breaks and CVS ignored it. Walgreens closed it’s stores- not CVS. And the Commissioners of Pharmacy? Never did or said anything! We did modules unpaid, filled prescriptions and did the Narcotic Inventory on our own time. The most flagrant abuse was forcing their managers in each store to find their own coverage, so they could attend manager meetings ON THEIR OWN TIME! And they did it! Protect your job. No union and we are in an “at will” state. There is NO INCENTIVE for CVS NOT to abuse us. They have taken away pay for holidays. No more time and a half. No day off. It is crazy! If you are scheduled to be off, you get the day off with pay. Wait. I had the day off with pay anyway. I’m salaried!. Scheduled to work? You work, but your partner gets the day off, with pay. You get to work- with pay. Huh? Oh- it’s going to be busy on the day after the holiday, so that partner is encouraged to come in on his day OFF – free- to help out. Yeah- I can’t figure it out either. Neither can they or anyone else. So no one fought it. I also saw hourly employees work 7 days and more in a row without any overtime pay. How? Wed to Saturday is one pay period and Sunday to Wed is another. How clever- 8 days in a row. two pay periods. NO overtime. PLEASE contact me. I have lots of stories. No one ever would talk to me But, I am in Connecticut.

    worked many overtime hours for CVS, but in Il. Only received straight pay. This dates back to 2002 to 2019. Are there any pending suits. Thanks Scott Bower. CVS PIC employee 0130400.
