Domino’s Delivery Drivers Wage Theft Class Action Lawsuit Overview:

  • Who: The franchise owner of a number of Domino’s Pizza locations in Georgia is being sued by his delivery drivers.
  • Why: The drivers say they were paid less than minimum wage by their employer.
  • Where: Georgia

Domino’s Pizza drivers who say they made deliveries for the brand on their own dime, without proper reimbursement, will be offered a settlement by a Georgia franchisee, the court has heard.

A notice of settlement of the class action lawsuit was filed in a Georgia federal court Oct. 22 by franchisee RT Pizza Inc, which owns multiple Domino’s locations. 

The notice of settlement comes after delivery driver Jessica Hurt filed a class action complaint in March 2020, alleging she worked for the Domino’s brand for 10 years and was underpaid for her delivery expenses the whole time.

Class Action Lawsuit Alleges Domino’s Pizza Delivery Drivers Make Less Than Minimum Wage

Hurt said she was paid $1.50 per delivery, which equated to about 15 cents per mile, well below the rate suggested by the IRS of between 53.5 and 58 cents per mile.

As a result, Hurt and other delivery drivers had to pay for gas, vehicle parts and fluids, repair and maintenance, insurance and other expenses out of their own pockets. 

The expenses left them making less than minimum wage, as dictated by the Fair Labor Standards Act (FLSA). 

Hurt represents all RT Pizza delivery drivers who were not properly reimbursed under the FLSA for the past three years.

Details of the settlement were not made public in the order Oct. 22, however the parties say they “will be filing the appropriate approval documents with the Court on or before November 5, 2021.” 

The class action settlement follows a number of similar cases around the country, with pizza delivery drivers arguing they have been underpaid for years. 

In July, a class action was filed against a Domino’s Pizza franchisee in New Jersey alleging the company grossly underestimates how much it should reimburse its delivery workers for the miles they drive on each shift, giving itself a financial kickback at drivers’ expense.

In August, certain delivery drivers for Domino’s Pizza reached a $480,000 settlement agreement resolving claims the business violated Washington wage laws.

    I wish I had been told about this too. I was a delivery driver 3 times from this company, and finally got so sick of the BS of working there. Not only unfair paid, mileage reimbursement, but also unfair mileage tracking, having mileage and tips taken if order was wrong in anyway(including order was made wrong, missing things, no one would answer the door/phone, and was outside delivery area, ect. None of what was the drivers fault and had done any/everything we could to delivery this to the ones who ordered it) which in my opinion should just be a company write off, and not taking it out on the driver who did go to the info provide, to at the end of the night find they removed these tips and mileage.) I can’t understand losing tips if you messed it up or maybe did something to cause an issue. But for them to take both tips and mileage away is not right in anyway(you drove the delivery there) most times the mess up was either done by the ones making it or the ones who ordered it. There is just so much about this bad company, it truly blows my mind how the get away with it. I mean I’m a single mother of two boys, that has always gone above and beyond any jobs I’ve had. When I finally decided that I wasn’t going to literally let a job/ the company I was working for kill me(from stress/overworked 40hr scheduled than made stay most night at least 2-3 hrs after the time wrote on the schedule) So I’d love to be able to get my far part. I live and worked in Anchorage, Ak

    I also never received anything about this. And now it’s says this settlement is closed. This is not fair to the driver’s that did not receive any information about this how can we receive our settlement’s

    I was a domino’s delivery driver 3 times. Someone had contacted me but I’ve moved and put my new address on the paperwork but haven’t heard or seen a check yet. I worked for the domino’s in Panama City beach, Florida and Piqua, Ohio. How would I get back in touch with them?

    My boyfriend is a Domino’s driver in Virginia and he filled out the paperwork to join the settlement and today May 9th he received a $1,600 check blood to the body

    I was opted in for lawsuit on dominos filed by Jennifer Watson in Glasgow Kentucky where was a delivery driver. Phone and all accounts been hacked and financial accounts taken over. Got the letter signed it sent it in and the lawyer and letter went too MINNESOTA. AND IVE NEVER HEARD OF ANYTHING SINCE SENT THAT IN. just getting lawyer on everything now and taking all too court. Need info on decision if possible. Thank you
