Asset-protection policies, practices and procedures to fight theft at Walmart target individual shoppers based solely on their race, a new lawsuit alleges. 

Plaintiff Marshae Jackson claims Walmart’s asset protection procedures are “disproportionately applied” to herself and “other African Americans versus similarly situated white shoppers.” 

Jackson argues Walmart “discriminated against her based-on race” due to her being “unlawfully, unjustly, and disproportionately, detained, charged, and prosecuted for alleged theft that occurred while using the self-checkout.” 

The incident in question occurred on or about June 1, 2021, when, Jackson claims, she was stopped and ultimately detained by a Walmart asset protection specialist who accused her of shoplifting. 

Jackson argues she had no intention to shoplift while using Walmart’s self-checkout to try and pay for her items, and that the store ultimately rebuffed her offer “to pay for any unscanned items indicating that it was just a simple mistake.”

“On or about June 1, 2021, Marshae Jackson was never allowed nor given the option to pay for the items she accidently failed to scan,” the Walmart lawsuit states. 

The procedures for self-checkout services in Walmart stores, meanwhile, “allow for and even facilitate the disproportionate targeting of African Americans” by store employees working as asset protection specialists, the Walmart lawsuit alleges. 

Walmart caused customer to suffer economic, emotional, mental harm, lawsuit says

Jackson claims she suffered economic, emotional and mental harm on account of Walmart’s allegedly discriminatory, policies, procedures and guidelines relating to asset protection. 

“Since the incident … coupled with the court appearances, Marshae Jackson suffered from great mental and physical stress, and continues to suffer today,” the Walmart lawsuit states.

Jackson claims Walmart is guilty of, among other things, negligently participating in a wrongful prosecution, defamation, misrepresentation, intentional infliction of emotional distress and false imprisonment, and of violating Title II of the Civil Rights Act.

Jackson, who ultimately had her case dismissed without an indictment, is demanding a jury trial and seeking injunctive relief along with an award of actual, statutory, compensatory and punitive damages. 

In January, a federal judge in New Jersey denied a bid by Walmart to dismiss claims the retail corporation discriminated against job applicants with criminal backgrounds.

    Dollar general did this to me I was mortified I left the store and took no items and they charged my card and I never received items they issued a gift card after they discovered I didn’t take it’s with me and did nothing about the public humiliation.

    This same sht had just recently happened to my 80 year old white Ukrainian grandmother. Has nothing to do with this women’s color in question to this article. She is just making a scene to make a face for herself and call out racism for her own pathetic reasons.

    I was targeted by off-duty police officer with a gun at the self checkout register after receiving assistance from one of the cashiers because I was unable to scan the items that I was trying to purchase I have a disability the young lady did assist me but just as I was getting ready to roll out the door the security guard stopped me and my husband because he had beer but the young lady had to ask him for his birthday I returned all the items to the customer service desk the security office informed me that she was trying to keep the store open and it was people like myself that come into the store to create problems after receiving assistance from the Walmart employee I couldn’t get an understanding I called in to file a complaint to store manager never called me back

    I had a bad experience at the Walmart Forest Park Illinois with the security officer after receiving assistance because I’m handicapped this lady at Target me asked me for my receipt after I pay for it every item that was bagged I showed the receipt and then I went to customer service and returned everything I was targeted because I was in a wheelchair.

    The front cashier assist with my purchase was unable to stand in a wheel chair and I was thankful as I was rolling to the door the security officer stopped me and asked me for my receipt she stated that it was foul Play because the young lady assisted me with my purchase I refuse to show her the receipt she called Forest Park police on me I tried to file the complaint in the store still manager never called me back Forest Park Illinois the security guard informed me the her reason for targeting me was this because she’s trying to keep the Walmart open because it has been death stealing going on.I this return all the items.

    I was in Walmart not long ago whereas a self checkout worker leaned against the self checkout machine and stared at me while I was checking out. I told her twice that she was making me feel uncomfortable. I told her if I needed her I would call her. I needed her 1 minute later, but she said, “no!” She eventually came over to help. There were several people coming through self checkout, but the worker continued to stare at only me. I pulled out my phone and laid it on the self checkout console to record her crazy behavior. I noticed that I have a record of her recording me. Is this right?

    Yes i was in walmart and thr same thing happened i was accussed of opening dvds and stealing them they took me to the back and searched me and ky purse and found nothing they actrd like it was no big deal. It was a huge deal.
