The Retail Equation Risk Scores Class Action Lawsuit Overview: 

  • Who: Dick’s Sporting Goods wants a class action lawsuit lodged against it, four other retailers and a consumer reporting agency sent to arbitration. 
  • Why: Dick’s claims the main plaintiff in the class action lawsuit has only lobbied claims against the sporting goods store and has already agreed to arbitrate any dispute.
  • Where: The class action lawsuit was filed in Pennsylvania federal court.

Dick’s Sporting Goods wants to send to arbitration a class action lawsuit claiming it and other retailers used an agency to assign customers a risk score based on their return tendencies. 

Dick’s claims the class action lawsuits’ central plaintiff, Susana Guevara, agreed to arbitrate any dispute when she purchased items on its website and declined to opt out of an arbitration agreement. 

Guevara is also the only plaintiff with claims specifically against Dick’s, surrounding a rejected return she attempted to make in June 2020, according to the motion. 

“Because a valid and enforceable agreement to arbitrate exists between DSG and Ms. Guevara, the Court must compel Ms. Guevara to arbitrate claims against DSG on an individual basis,” Dick’s motion states. 

Plaintiffs Accuse 5 Stores Of Transmitting Data To Agency, Assigning ‘Risk Scores’ To Customer

Guevara and four other plaintiffs accuse five different stores, including Advance Auto Parts, Best Buy, Buy Buy Baby, Dick’s and Famous Footwear of transmitting their data with The Retail Equation Inc., which led to them getting denied the ability to make returns or exchanges. 

The Retail Equation would use software to assess customers who made returns a “risk score” that would determine how likely they were to engage in acts of fraud or criminal acts, according to the class action lawsuit. 

Plaintiffs claim that the on-the-spot recommendations the company would send to the retail stores were without their knowledge, a violation of privacy and a violation of state and federal data laws, Law360 reports. 

Guevara and the plaintiffs claim The Retail Equation also violates the Fair Credit Reporting Act by wrongly marking people as criminals and for not informing customers of their risk scores upon request. 

A separate class action lawsuit was filed against Dick’s last year over allegations the company’s website is not fully accessible to blind or visually impaired consumers

    first dicks removing 5,000 points then they make bbb thank I committed fraud on my account, then they finally send me a gift card for $160, I purchase 2 pair of shoes online, both had issues both were to small, 1 nike 1 timberland boot dicks had me return some shoes in store, then they told me they added the money back to my original gift card, but never did add the money to the gift card, when I tried to use the gift card no funds were on the gift card, when i told customer service they asked me for a receipt to make sure the money was on the card, then they obviously closed the new gift card that they put the money one which I never recieved, and never refunded me the $160 that was on the original gift card…..then they never refund me i go back inside the store and speak to them and then I receive a cest and desist letter telling me not to contact them again threaten to arrest me if I step foot back in the store then I file a arbitration and they refuse to send me a cest and desist letter and and put the money on a gift card for their own personal interest, and this should not be closed because they said they would send me a $160 gift card but never sent me the gift card, i even have the emails that they asked for the receipts for the shoes i returned back then i got a call and a email from a supervisor who promised me a $160 gift card that i never received all because they removed $160 in rewards points from my account and then they closed my account and never refunded me the $160 that i am owed, they even asked for my receipts to issue me a gift card but never sent the gifcard…then after they get my receipts and never give me the $160 they send me a cest and desist letter so this should not be closed after they basically kept my money and never sent my money back if they dont wanna give me the gift cards they can just refund me my money because they not going to quiect me by sending me a cest and desist letter because they refused a arbitration and they also violatted their arbitration agreement and they violatted a customer by keeping my money and/or refund becase they never issued me a gift card…they also refused to follow the arbitration and they never ignored the arbitration

    I’m not sure what is going on with dicks lately but we are going through some major issues with some bicycles that we purchase that were unsafe for the road and one instant. My wife almost went off the side of a mountain because she lost her brakes The same day of the purchase. We return both bikes that we purchased so they can get fully checked out and instead we upgraded to more expensive bikes. We took the more expensive bikes home and decided to come back for E bike so we purchase additional E-bike which was again not safe for the road because the handlebars turned on me sending me off the bike and into the ground. We returned that bike because it wasn’t up to spec. They exchange the e-bike apologizing profusely and us buying a more expensive e-bike which was supposedly again tacked out and rode worthy. Well that same night come out on the trails riding around my family. I had a bump and the front wheel falls off. The wheel gets twitched his sideways again. I get tossed to the ground injuring my leg even further. At this point we take the bikes again back to Dick’s sporting goods. Their manager Matt was about as rude as can be the certified technician embarrassed. My wife and made it seem like it was her fault and has turned us into a huge debacle. Has anybody else had any problems with the unsafe bikes being sold from dicks and if so what recommendation would you make because this has to stop something has to give before someone gets killed or seriously injured

    I was refunded and now they are pursuing criminal charges on me because the sales lady never checked the returned item.
