Restaurant chain Boston Market failed to pay minimum wage and overtime to employees at its Arizona locations, a new class action lawsuit alleges.
Plaintiff Jose Tejeda claims Boston Market regularly would pay its workers in Arizona either late or not at all, during a given workweek.
Tejeda argues Boston Market violated both the Fair Labor Standards Act (FLSA) and the Arizona Minimum Wage Act with its alleged unlawful wage practices.
“Defendants’ failure to compensate Plaintiff and all similarly-situated employees at a rate equal to Arizona’s required minimum wage violates (Arizona Revised Statutes),” the Boston Market class action states.
Tejeda wants to represent an Arizona class of individuals who worked at Boston Market location in the state and who did not receive the legal minimum wage and/or wages due as a result of not receiving a paycheck on time or at all in a given work week since May 2023.
Boston Market temporarily closes most Arizona locations partially as result of failure to pay workers, class action says
Tejeda argues Boston Market has failed to pay any wages to any of its employees at its Arizona restaurant locations since May 2023, representing a period of approximately between two and four biweekly pay periods.
“Such a practice violates the FLSA’s overtime provisions for Plaintiff and the Collective Members who were non-exempt and worked in excess of 40 hours in a given workweek without receiving an overtime premium for such time worked,” the class action states.
Tejada claims further that Boston Market has had to temporarily close most or all of its Arizona Boston Market locations, “apparently at least partially as a result of their failure to pay their employees.”
The plaintiff is demanding a jury trial and requesting an award of compensation for unpaid wages along with trebled damages for himself and all class members.
A separate class action lawsuit was filed against Boston Market in March over claims one of its New Jersey restaurant locations failed to ensure its property was accessible to individuals with disabilities.

This happened across the country. Not just Arizona. I live in Illinois and I have since left Boston Market but they owe me two paychecks still, plus unpaid reimbursements around $1000, plus they never paid out my 80 hours of unused vacation time when I left the company. They owe me about 4-5k.
Not to mention I never received my W2 from them this year for 2023 taxes.
I worked part time for Boston Market in Arizona recently for over six years. With the new ownership, I noticed a number of changes and in particular, the paychecks did not come on time for about a month.!
This is in Michigan too. Working and no paychecks coming. Lying to the employees saying they are getting paid. My niece was a GM. They owe her like 6k. It really messed up her life. Hopefully, she will get paid back.
