Amazon wage-and-hour lawsuit overview:

  • Who: Plaintiff Cyle Dixon filed a class action lawsuit against Amazon delivery provider Regional Express.
  • Why: Regional Express allegedly failed to pay delivery drivers all of the compensation they were owed.
  • Where: The Amazon wage-and-hour class action lawsuit was filed in Ohio federal court.

Amazon last-mile delivery provider Regional Express Inc. and its subsidiaries have been hit with a class action lawsuit alleging they failed to pay drivers all of the wages they were owed.

Plaintiff Cyle Dixon alleges Regional Express employed him as a non-exempt driver paid on an hourly basis from August through November 2022. He claims he was not paid for mandatory time working before and after his scheduled shift times or for missed meal and rest breaks, according to the wage-and-hour lawsuit.

Wage-and-hour lawsuit says drivers not paid for mandatory work

Dixon alleges that he was required to arrive approximately 10 minutes before his scheduled shift to perform mandatory work, such as attending meetings and obtaining keys and gas cards, but was not paid for this time. The wage-and-hour lawsuit says that these tasks were “integral and indispensable” to the delivery job he was hired to perform.

Additionally, Dixon says he was not paid for all compensable work performed at the end of his shifts. In some cases, he would not return to the work location until more than an hour after his shift was scheduled to end because he was still delivering. However, he says he was not compensated for this time.

Dixon also says he routinely worked more than 40 hours in a workweek but was not paid overtime in violation of federal and state law. The defendants also allegedly failed to pay him for the rest and meal breaks that he regularly missed and continued to deduct a full 30-minute lunch break from his pay, even when he did not take an uninterrupted lunch break.

Dixon filed the wage-and-hour lawsuit on behalf of himself and a proposed class of current and former hourly delivery drivers who worked at least 40 hours during a work week in the past three years.

The wage-and-hour lawsuit asserts claims for violations of the federal Fair Labor Standards Act and violations of Ohio law.

  1. Stephanie L Theodore says:

I would like a lawyer to contact me. I was with Amazon Flex for almost 5 years. I’m disabled and they didn’t respect a doctors letter concerning my disability that lead to my safety not being considered. They recently terminated my contract. Even after they removed this incident off my delivery history. I have every email from their support team. Proving I belive I was harassed out of my job. You have my permission to contact me for more details.

You have a pic for Regional Express airlines Australia. This is totally wrong and you have dragged a poor Australian airline that has nothing to do with this class action.
