UVA Health System class action lawsuit overview: 

  • Who: Six former University of Virginia Health System employees have filed a class action lawsuit against the health center. 
  • Why: The former UVA Health employees claim the health system systematically refused religious accommodation exemption requests made by employees who did not want to take the COVID-19 vaccine. 
  • Where: The class action lawsuit was filed in Virginia federal court. 

The University of Virginia Health System systematically refused religious accommodation exemption requests from employees who did not want to take the COVID-19 vaccine, a new class action lawsuit alleges. 

Six former UVA Health employees claim UVA Health violated the First Amendment, including by allegedly having a list of favored and disfavored religious groups and dismissing the religious beliefs of those in the disfavored category. 

The former UVA Health employees argue UVA Health “automatically dismissed” religious exemption requests from employees from “disfavored” religions as “insincere, as non-religious in nature, as based on ‘misinformation,’ or as a misinterpretation of the objector’s own religious beliefs.” 

“Therefore, for employees who were not on UVA Health’s list of officially approved religions, UVA Health denied exemption requests en masse,” states the UVA class action. 

Former UVA Health employees want to represent ‘disfavored religion’ class and ‘abortion objectors’ class

The former UVA Health employees want to represent a class of employees who had their religious exemption requests denied after being categorized as being a “disfavored religion” and a class of individuals who were denied exemption requests made based on the vaccines’  “association with abortion or cell lines or tissue from aborted fetuses.” 

UVA Health is accused of violating the First Amendment’s Establishment Clause and Equal Protection Clause, along with the Virginia Constitution’s Establishment Clause, and Free Exercise guarantee

The former UVA Health employees are demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, compensatory, and punitive damages for themselves and all class members. 

A similar class action lawsuit was filed last month against President Joe Biden and U.S. Attorney General Merrick Garland by an individual arguing Biden violated the civil rights of federal employees by forcing them to take the COVID-19 vaccine.

    I was told to fill out my religious exemption paper work and was denied twice. Just to be let go on October of 2021. Which was the deadline to take the Vaccine. I worked as a vendor in the UVA hospital kitchen.

    I was denied the ability itself of receiving either medical or religious exemption. I worked at the hospital for 10 years in IT department. Was told by my bosses to fill out my exemptions until the last week or 2 when i was informed because I was a subcontractor I was not eligible to submit either. This in spite of the UVa Healthsystem policy that clearly stated I WAS eligible.

    Female 68yrs Used Johnson& Johnson Baby powder, Used L’Oreal perms and Other Brands, Fibroid tumors, is this disallowed, although it causes hemorrhaging and death
