A federal judge in California on Friday granted final approval to a $10.4 million class action settlement resolving about 24,700 CVS Pharmacy employees’ claims that the company failed to pay them the overtime wages they were due.

Lead plaintiff Sevag Chalian in 2016 had alleged CVS Pharmacy required its pharmacists to complete certain training modules off the clock, a violation of California law. Chalian’s class action lawsuit was consolidated with another similar case in 2020.

Two Classes have been certified: a Pharmacist Settlement Class and a Retail Pharmacy Settlement Class.

The Pharmacist Settlement Class is made up of all hourly, non-exempt retail pharmacists who worked in Regions 65 or 72 in California between July 20, 2012, and the date of the preliminary approval order in October 2020, whose claims are not subject to arbitration and who have not previously released and/or adjudicated the released claims, and whose LEARNet and/or Site Minder data indicates activity when time punch records do not show the retail pharmacist was clocked in.

The Retail Pharmacy Settlement Class includes anyone who is not a member of the Pharmacist Settlement Class who held an hourly, non-exempt position in a CVS retail pharmacy in California between Aug. 3, 2014, and the date of the Preliminary Approval Order who has not previously released and/or adjudicated the released claims.

The maximum settlement amount will be $10,371,346.60, which will be used to pay Class Member awards, attorneys’ fees, settlement administration expenses, and other costs. After other expenses are deducted, about $7,548,124.18 is expected to remain in the net settlement fund for Class Member payments.

Class Members each are expected to receive an average payment of $307.

    I work for CVS in Lake Ozark Missouri September of 2021 to present. In 2023 for 5 months I was the only front end employee working overtime every week, with no store manager. The Store Manager was forced to retire or she was going to get firedI think being paid straight time for my overtime and still getting straight time for overtime.
