A Florida woman recently filed an Unum LTD benefits lawsuit against the insurance giant, alleging that she was improperly denied her long term insurance claim.
The plaintiff, Jacqueline J., alleges she was provided with long term disability (LTD) coverage through her employer, Vanguard Cellular Financial Corp. Unfortunately, Jacqueline says she became disabled in October 1996, leading her to make a claim for her Unum LTD benefits that her coverage that she received as an employee of Vanguard.
She alleges she was initially approved to receive Unum LTD benefits in April 1997, and continued to receive these benefits according to her policy until February 2014—nearly a full 17 years later. Then, on Feb. 18, Unum’s decision to grant Jacqueline her Unum LTD benefits was reversed.
Although Jacqueline appealed Unum’s reversal, she alleges her claim was once again denied in August 2014, despite the fact that she is still affected by the same disability that prevented her from working for that 17-year period in which she was granted her Unum LTD benefits.
Having exhausted all administrative means of appealing Unum’s decision, Jacqueline still had another route to combat the denial: litigation. Jacqueline filed her lawsuit over unfair Unum LTD benefits denial on March 15, 2018.
Wrongful Denial of Unum LTD Benefits
Jacqueline is not the first person to have been denied Unum LTD benefits she should have received under Unum policy. Some who have become disabled seek reinstatement of their disability benefits by pursuing all the administrative means available to them, including filing appeals to reverse Unum’s decision.
However, even when a person attempts to appeal in this manner, Unum may still deny their appeal. If the appeal approach proves unsuccessful, some turn to legal means to reverse the company’s claim denial.
A growing number of plaintiffs like Jacqueline have begun filing a Unum disability insurance lawsuit against the insurance giant. Lawsuits allege that the company unfairly denied their Unum benefits claim that they qualify for under the terms of their insurance policies provided by their employer.
This Unum disability insurance lawsuit and others like it allege that Unum has unfairly denied the disability insurance claims of plaintiffs who are qualified to receive such benefits. Some lawsuits go further, alleging that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other to increase company profit.
