A Minnesota man recently filed a disability benefits lawsuit against Unum Life Insurance Company of America, claiming that the company unjustly denied him benefits he was qualified for.
Plaintiff Anthony W. was employed by Abra Auto Body and Glass. As an employee, the plaintiff was registered under a long-term disability insurance policy from Unum.
According to his disability benefits lawsuit, Anthony’s health condition had deteriorated to such a point that he was forced to stop working on September 10, 2012.
Because he was unable to perform his duties with Abra Auto Body and Glass due to his health, Anthonyapplied for and was initially approved for long-term disability benefits though his insurance plan.
However, Anthony received a letter from Unum dated March 2, 2015, nearly three years after he was initially approved, stating that his long-term disability benefits claim would be terminated on March 8, 2015.
The reason that Unum gave for this termination of disability benefits was that the company had determined that Anthony was now able to perform the duties that his position with Abra Auto Body and Glass required.
Anthony, who claims he has not substantially recovered and is still unable to perform his duties, appealed this reversal of benefits. Despite his appeal, Unum informed Anthony on March 21, 2016 that his claim was still denied.
Though Anthony had exhausted all recourse in terms of administrative power, he was still able to file a Unum disability benefits lawsuit.
The disability benefits lawsuit alleges that Unum unjustly denied him disability benefits, violating the terms of ERISA.
