Curamin fails to provide the pain relief promised on the products’ labeling, according to a recent class action lawsuit against the manufacturer.

Plaintiff Michael Dotson says he has purchased several Curamin products, including Curamin Extra Strength Pain Relief, Curamin Headache Relief, Curamin Pain Relief, Curamin Stop Pain Now and Curamin PM Nighttime Pain. His most recent purchase of Curamin was in September 2020.

Unfortunately, the plaintiff claims these purchases hinged on misleading statements from the product manufacturer. Dotson alleges manufacturer Euro Pharma Inc., doing business as Terry Naturally, misrepresented its Curamin pain relief product in order to take advantage of consumers.

Unlike other pain relief products, Curamin products rely on curcumin, also called diferuloylmethane, which is a primary component of turmeric and other related plants. Turmeric is widely used in alternative medicine for anti-inflammatory purposes. In fact, studies of curcumin have shown that dietary supplementation for extended periods of time can help reduce inflammation.

However, although studies have supported the use of curcumin for anti-inflammatory purposes, studies have not consistently shown the same support for curcumin in the treatment of muscle soreness associated with exercise.

Despite this lack of information, Terry Naturally allegedly markets their Curamin products as able to help relief muscle pain. Nowhere on these products does the company disclose the fact that muscle pain relief is not a proven benefit of curcumin.

Instead, the company allegedly misleads consumers with statements promising “Effective Pain Relief” and other similar benefits.

Powdered turmeric next to turmeric pills - pain reliefDotson argues he and other consumers had no way of knowing that Terry Naturally’s representations were false. Instead, based on the company’s representations, they were allegedly misled into believing the products would help their pain.

“By making false and misleading claims about the pain relieving effects of its products Defendant impaired Plaintiff’s ability to choose the type and quality of products he chose to buy,” the Curamin class action lawsuit contends.

“Therefore, Plaintiff has been deprived of his legally-protected interest to obtain true and accurate information about his consumer products as required by California and Federal law.”

According to the Curamin pain relief class action lawsuit, Dotson and other purchasers would not have bought the product if they had been aware the product would not provide pain relief as promised. As a result, consumers allegedly sustained monetary injuries due to Terry Naturally’s conduct.

“Worse than the lost money, Plaintiff, the Class, and Sub-Class were deprived of their protected interest to choose the products they ingest,” the Curamin pain relief class action lawsuit alleges.

The Curamin pain relief class action lawsuit includes claims of fraud, unjust enrichment and violation of California’s Unfair Competition Law. Under these claims, Dotson seeks actual damages, punitive damages, statutory damages, interest, court costs and attorneys’ fees on behalf of a proposed Class.

Dotson seeks to represent a Class of consumers who purchased Curamin pain relief products within the last four years. He also seeks to represent a subclass of the same consumers who purchased Curamin pain relief products in California within the past four years.

Curamin products in these Classes are Curamin Extra Strength Pain Relief, Curamin Headache Relief, Curamin Pain Relief, Curamin Stop Pain Now and Curamin PM Nighttime Pain.
