SiriusXM lawsuit

Satellite radio provider SiriusXM has established a multistate settlement program for previously unresolved complaints that relate to a matter that occurred between July 28, 2008 and Dec. 4, 2014. In addition to paying $3.8 million to the states involved in the settlement, SiriusXM will also pay restitution to consumers who have unresolved complaints.

The SiriusXM settlement was reached in response to numerous complaints received by the state attorneys general with regard to SiriusXM’s billing and cancellation practices. The attorneys general of 45 states and the District of Columbia alleged SiriusXM misled consumer with its advertising and billing practices in violation of state consumer protection laws. In 2010, they launched an investigation into SiriusXM’s automatic renewal policies and determined the satellite radio provider violated consumer protection laws.

The attorneys general took issue with a number of certain consumer complaints regarding cancellation requests, unauthorized fees, and failure to provide timely refunds. SiriusXM allegedly, without customers’ consent or knowledge, automatically renewed subscriptions; failed to honor cancellation requests; billed or charged payment cards or withdrew money from customers’ bank accounts; failed to make timely refunds with regard to cancellation requests for automatically renewed services; failed to issue refunds; and misrepresented to customers that the services were cancelled and refunds were issued.

The states included in the SiriusXM settlement are Alabama, Alaska, Arizona, Arkansas, Colorado, Connecticut, Delaware, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia and Wisconsin.

Who’s Eligible

To be eligible for benefits from the SiriusXM settlement, your complaint must be on specific topics, be unresolved, and relate to a matter that occurred between July 28, 2008 and Dec. 4, 2014. In addition, you must reside in any state or the District of Columbia, other than California, Hawaii, Wyoming or New York.

Consumers must file a complaint about SiriusXM conduct that occurred between July 28, 2008 and Dec. 4, 2014, involving an actual loss that has not been resolved with the state Attorney General’s office.

    Was never offered any deal. liked having Sirius on new car radio,but was never contacted.

    California should be part of any class action against Sirius radio. Just before renewal time, Sirius called me and offered a good price to renew for 6 months. I agreed. When I called to find out why my navigation was not working, they said I did not pay for it cause navigation was separate.

    I was suppose to get system free, but had to pay for it, charges for service is being charge a higher price and paying yearly, I should be getting discount, that not happening and when called was billed $15.00 dollars charge. So do I need to stop at end of when my year up, which is in June 2015.

    I continue to get harassing phone calls from Sirius. I am grateful for Home Depot coming clean about their credit card security issue, because my bank gave me a new card. Sirius called to find out why their charge would not go through. It was then I found out that the two years service contract provided for the auto dealer was not being honored. It gets much worse than that. They were billing my old credit card more than $57.00 a quarter. Really, would anyone pay that much for their service. I think not, but to do it behind and without agreement from a customer is just wrong. They had the nerve to send me a statement in the mail for the part of the month they said I used without them being able to bill my credit card. Yes, it get even worse, they put a late fee on it. Never will I use Sirius and hope the lawsuits put them out of business.

    Filed a claim as I tried to cancel Sirius after selling my car years ago. I have emails stating they will refund my money ,but they never did. After filing with this class action they emailed me saying they have been trying to reach me? Yet never called. I emailed back with a time they could call. They again did not call- then emailed me saying they are trying to reach me and the number I gave them was bad. Strange as I have had the same phone number for 10 years…….Guess they are making the same effort to assist as they did years ago.

    they were trying to charge me 199.00 for a year after talking to 5 different people got it down to 110.00
