Hertz recalled cars investigation overview: 

  • Who: The National Highway Traffic Safety Administration (NHTSA) said in a filing made public Tuesday that it has opened an investigation into rental car company Hertz. 
  • Why: The NHTSA said it is investigating Hertz’s alleged practice of renting vehicles that are under recall and that have not yet been fixed.

The National Highway Traffic Safety Administration (NHTSA) has announced that it has opened an investigation into Hertz over the rental car company’s alleged practice of renting out recalled cars that have not been fixed.

The NHTSA revealed in a filing made public Tuesday that it will be auditing Hertz’s recall record for vehicles owned by the company from 2018 to 2020, specifically looking at Nissan and Ford model vehicles that were under a recall notice during that time, Politico reported

“NHTSA is in receipt of information that indicates Hertz rented vehicles to customers without having performed required recall repairs. Accordingly, we are opening this audit query to seek additional information concerning this issue,” the NHTSA said in its filing. 

The federal auto safety regulator reportedly said it has been reviewing information since last year related to Hertz allegedly renting out vehicles under recall that had not had the required recall repairs performed on them.

“NHTSA is opening this audit query to investigate whether The Hertz Corporation (Hertz) has complied with the requirements of the National Traffic and Motor Vehicle Safety Act (Safety Act),” the NHTSA said in its filing. 

Rental car companies not allowed to rent out vehicles subject to a recall that have not been fixed, NHTSA says

The Safety Act mandates that, among other things, rental car companies must not rent a vehicle subject to a recall unless the issue that led to the recall has already been remedied, according to the NHTSA. 

Hertz agreed to pay $168 million earlier this month to resolve claims the company falsely reported missing vehicles stolen, resulting in customers being wrongly detained by law enforcement. 

Customers argued Hertz would report vehicles as missing in the event they could not immediately find them, but then failed to enter the thefts into their systems before later renting out vehicles reported as stolen to new, unsuspecting customers.

    I have been given a car from hertz that has an active recall on it and was put in danger less than 24 hours of renting because of so.

    I have rented cars from Hertz while driving for Lyft during that time frame in Sacramento, I remember driving Nissans, I do have my receipts somewhere. I would have to dig. Is there a way to send a list of the year make and model so I can check if I qualify?
