FanDuel Fund Withdrawal Denial Class Action Lawsuit Overview: 

  • Who: Paul Manganaro filed a class action lawsuit against FanDuel, Inc. 
  • Why: Manganaro claims FanDuel breaks the law by refusing to let bettors withdraw funds that have not been played through. 
  • Where: The class action lawsuit was filed in the Superior Court of New Jersey. 

FanDuel breaks the law by not allowing bettors to withdraw funds that have not been gambled or played through from their accounts, a new class action lawsuit alleges. 

Plaintiff Paul Manganaro claims FanDuel is in violation of the New Jersey Consumer Fraud Act by requiring bettors to play through any deposited funds before being able to withdraw them. 

Manganaro wants to represent a New Jersey class of individuals who have deposited money into FanDuel and weren’t allowed to withdraw it before playing through it first. 

Manganaro says he created an account on FanDuel and deposited $500 in February “in large part due to the advertising materials indicating that consumers could easily and conveniently deposit and withdraw funds.” 

FanDuel specifically advertises the ease at which bettors will be able to deposit and withdraw funds, in an effort to “induce potential consumers into signing up and placing sports betting wagers,” the class action lawsuit alleges. 

Further, Manganaro argues FanDuel falsely advertises that bettors can “withdraw deposits and/or winnings at any time for any reason.” 

“However, it is clear … that Defendants’ advertisements are fraudulent, misleading, and incorrect, and consumers are unable to withdraw deposited funds without betting them first,” the class action lawsuit states.

Manganaro claims that, after losing an initial $200 bet, he decided to withdraw the remaining $300 balance but was denied and told by FanDuel through email that “you can only withdraw winnings or eligible promotions.”

FanDuel ‘Illegally Holding’ Funds That Have Not Been Bet 

“Defendants are currently impermissibly and illegally holding Plaintiff’s funds and refusing to return them unless and until Plaintiff bets such funds,” the class action lawsuit states. 

Manganaro claims that nowhere in the terms and conditions provided by FanDuel does it state that funds placed in an account must be played through before they are able to be withdrawn. 

“Prior to creating his account with FanDuel, Plaintiff was aware of the Defendants’ Terms of Use and Terms and Conditions and the advertising’s claims that he could deposit and withdraw funds from a FanDuel Sportsbook account easily and at his discretion without gambling all of his monies,” the class action lawsuit states.

Manganaro claims that, in addition to being in violation of the New Jersey Consumer Fraud Act, FanDuel is guilty of conspiracy, fraud and breach of contract. 

Plaintiff is demanding a jury trial and requesting injunctive relief along with restitution and compensatory, treble and punitive damages for himself and all class members. 

In January, FanDuel competitor DraftKings agreed to pay $325,000 to resolve claims the sports betting platform enabled problem gamblers by violating gambling laws.

FanDuel had previously agreed to donate $375,000 to a gambling addiction organization to resolve the same claims in July 2021.

      I put money on fantasy instead of the casino, they won’t transfer it won’t let me instant withdraw it instead the made me get a refund issued that takes 3 to 5 business days. So the can make money off me and my interest. They are scum

      Cashed out at the cashier 3500 black blackjack live and the next morning my account is suspended. Don’t know if the money is ready for pick up but I have the email confirmation. Seems shady to me

      Yes I tried to withdraw funds from FanDuel also that I didn’t gamble and they sent me a email denying my withdrawal saying I can’t withdraw unless they were funds I won or a promotion I want my money

    I’m owed $300 and had my account suspended when I tried to withdraw my money. It’s been a nightmare.

    Same problem here, i deposited $250. Lost $50 i tried to withdraw $200 and my account got suspended, they kept my money. i’ve been calling and emailing customer service with no success on getting my money back or my account.

    won $4k 4 days ago. started a withdrawal and was told it was being processed via email. Then received an email a day later to say the withdrawal request wasn’t successful to my bank account. So i then tried withdrawal to Paypal. Originally the bank withdrawal said it would take 24 hours. The paypal W/d said it would take 48 hours. Anyways after the request for paypal, i received an email that said the wd request didn’t go thru because it included funds ineligible for withdrawal. the email went on to say “you can only withdrawal winnings or eligible promotions”. I bet a 5 game parlay $200 and hit, winning $4k. Winnings! which is what they said i can withdrawal. yet somehow i can’t. 90 minutes later, i received an email from Fanduel Racing; something i have never logged into, to say we suspect unusual activity on your account so your account is suspended. Has been 3 days. every contact with customer support is the same. the account team blah blah blah. this is definitely shady now that i come and see all this activity going on. Wow. i would like to be contacted with this case or any case moving forward against Fanduel.

    Yea they got me to I hit a 15 pick parlay last Thursday an put $5 on it an ending up winning like $3000 an as soon as my game was over I went to log back in an it told me that I had excluded my account an I’ve been locked out every since an that customer service /email/bot shit is bull

    Won 10k over the weekend. Deposited 3,000 of it myself. Tried to withdrawal 4,600 on Sunday and my account was suspended Monday am. Haven’t heard a word back but currently have $10,000 in my account and can’t access it. Even my initial 3,000 of my own money I deposited, bet, and won.

      78000 tried to withdraw. None came back. Then another 13 thousand. It is a scam and illegal. Have everything time stamped and will be pursuing lawsuit.

      Brother I deposited 981 won 7k I have zero withdrawalable funds I’ve contacted support they disconnect or just rude and say we are not paying you back. I even told them I’m recording and they still don’t care I have video proof of my number hitting in craps and not deposit into my winnings I contact them every time and they say they don’t see that bet was placed always lying when I have video proof
