Noom Subscription Class Action Lawsuit Overview: 

  • Who: A federal judge moved a class action lawsuit lodged against the popular diet app Noom, Inc one step closer to trial. 
  • Why: The company failed to convince a judge to drop claims from a consumer who alleged that her Noom subscription was automatically renewed without her consent.
  • Where: The class action lawsuit will proceed in New York federal court. 

A federal judge in New York upheld a class action lawsuit against Noom, a popular health and wellness subscription-based diet app. 

A total of 274 class action counts at a value of more than $100 million were reportedly sustained by Judge Lorna Schofield, who subsequently denied the company’s request for dismissal, according to a Tuesday order. 

The class action lawsuit was filed by a Noom user who alleged the company engaged in an auto-renewal scheme that tricked customers who believed they were signing up for a trial period, but were unexpectedly slapped with new subscription fees when the trial ended. 

Judge Schofield agreed that the Noom subscribers could not have reasonably known they were registering for more than a trial period based on the steps they had to go through to sign up to that point. 

“This suit will prove that Noom engaged in one of the largest auto-renewal scams in American history,” a lawyer representing the plaintiff said in a statement

“Consumers were led to believe that they were enjoying a free trial period but instead were charged for an entire year’s worth of service. To make matters worse, Noom failed to provide any reasonable way to cancel or get a refund.”

Noom Subscriptions Unexpectedly Renewed 

Plaintiff Geraldine Mahood first filed the Noom subscription class action lawsuit in May of last year. Mahood alleged she was unable to cancel the subscription before the end of her $10 14-day trial period, resulting in her automatically being enrolled in the full service at a cost of $99.

The class action lawsuit alleges Noom also misled consumers by charging them non-refundable fees of up to $199 for multi-month diet programs they didn’t ask for or use. 

Noom has received a total of $560 million in investments from celebrities and venture capitalists over the years, including tennis-star Serena Williams, Sequoia Capital, and Silver Lake.

The company is heading towards an IPO led by Goldman Sachs later this year. 

A similar class action lawsuit was filed against The Washington Post alleging deceptive automatic renewal terms. A California district ruled last month that the $6.7 million class action lawsuit could move forward.

    I notified my ‘counselor’ to cancel my trial membership a month after I signed up. When I saw the debit of $129.00 from my checking account I called Noom and spoke to someone from Wellness Intelligence 😂 who said she could only reimburse me for 1/2 of what I was charged, $64.50. Very deceptive and unapologetic practices!

    I tired the “Free Trial” and notified Noom one day later to cancel. They charged me $150.00 dollars on January 12, 2022. I can’t contact anyone to fix this.

    I signed up in 2021 for a free trial and before I even had a chance to look at the website I was charged $200 bucks and I contacted them and still haven’t received my refund.

    I tried canceling last year and couldn’t, charged the subscription after the free trial but was unable to cancel it before or the day of the charge.

    Was finally able to cancel, but Noom refused to refund the $129 they charged me for the 4-month automatic renewal.

    Was told three or four payments would cover a year starting June June 2021. Now after six months I am being billed $37.25 every two weeks. I have demanded a refund and was not allowed to talk to a supervisor. Noom site won’t reveal contract terms. Please contact me.

    Noom has billed me for over a year with out my authorization. I deleted the app in oct 2020 and was still charged 111.00 for a semi annual subscription (twice). They are using the billing information through the Itunes store without my authorization. Please feel free to contact me as I have full documentation of the charges.

    My husband and I have experienced this for multiple years now. We continue to be charged after we have cancelled our subscriptions multiple times. Just happened again in October. Please reach out. We would love to join this lawsuit and provide supporting documentation.
