A Michigan resident recently filed a disability benefits lawsuit against Unum Life Insurance Company, alleging that the group unlawfully denied his claim and violated federal law.
The Unum lawsuit states that plaintiff Michael B. was provided for under the insurance plan of his employer, Denso Air Systems, and administered and funded by Unum Life Insurance.
The complaint was brought under the Employee Retirement Income Security Act (ERISA).
According to the disability insurance lawsuit, Michael was employed by Denso Air Systems beginning in November 2002. Over time, the plaintiff was diagnosed with a series of medical conditions, including but not limited to central disc protrusions, back and spinal issues, and hypertension. Due to these issues, the Unum lawsuit says, he is unable to stand or walk for significant periods of time, which inhibits his ability to work.
Michael was forced to quit working for Denso as a result of these medical issues. He stopped working in March 2013.
Shortly afterward, the plaintiff applied for short term disability benefits, which were granted, and then switched to long term disability benefits in June 2013. These long term disability benefits continued until July 2015, but were then terminated.
Unum’s decision to terminate the plaintiff’s disability benefits was appealed, and though the plaintiff brought medical documentation stating that he was “totally and permanently disabled” from full time occupation, Unum upheld their decision.
Although Unum rejected the appeal, the company informed the plaintiff he had the right to bring a civil suit under ERISA, which he did.
Michael B.’s lawsuit claims that Unum’s failure to pay full disability benefits directly violates the company’s insurance plan.
