L’Oreal sunscreen class action overview:

  • Why: The plaintiff says L’Oreal deceptively markets its makeup so consumers believe they are getting 24 hours of sun protection, when they are not.

L’Oreal makes cosmetic products that mislead customers into thinking they are buying a product with 24 hours of sun protection, when they only offer a maximum of two hours sun protection, a new class action lawsuit alleges.

Plaintiff Lynn Zimmerman filed the class action lawsuit against L’Oreal USA Inc. Dec. 2 in a California federal court, alleging violations of the state and federal consumer laws.

Intending to profit from consumers’ desire to protect their skin from the sun’s harmful rays, L’Oreal developed cosmetic products with SPF protection and sold them under a variety of brand names, including L’Oreal Paris and Lancome, Zimmerman says.

L’Oreal misleadingly labeled these products with “24H” claims to boost its bottom line, such as “Up to 24 H Fresh Wear” and “Up to 24HR” along with SPF claims such as “SUNSCREEN BROAD SPECTRUM SPF 25,” she says.

However, the products do not and cannot provide 24 hours of SPF protection, the lawsuit states. “The products’ labels are therefore false, deceptive and/or misleading.”

L’Oreal’s marketing hides pertinent information, class action states

L’Oreal’s products do contain a drug facts label that states “reapply at least every 2 hours,” Zimmerman says.

However, the drug facts label is printed underneath a sticker on the back panel of the product, thus making it redundant when compared to the misleading labeling, the lawsuit states.

“When a consumer looks at the Product in the store, they will not see the instruction to reapply the product every 2 hours unless they lift the sticker on the back label and find the appropriate page of the multi-page drug facts label.”

Zimmerman is looking to represent anyone in California who purchased the allegedly deceptively labeled products between Dec. 2, 2018, and now.

She is suing for violations of California consumer laws, false advertising, fraud, and unjust enrichment and seeking certification of the class action, damages, fees, costs and a jury trial.

Meanwhile, a 2021 class action alleges L‘Oreal sells a range of high-priced collagen skincare products that promise to smooth wrinkles, however its promises are false, because collagen is “worthless” when applied to the skin.
