Copper Chef set of pots and pansA class action lawsuit has been filed against Tristar Products by consumers who claim that their Copper Chef cookware is defective.

Plaintiffs Marshall Slutsky and Glenn Graeves allege that Tristar Products market their Copper Chef cookware as having non-stick technology and their pans will never peel, scratch, or chip. 

In addition, the plaintiffs say that because of these claims, Tristar states that their pans will last a lifetime.  

The Tristar Products class action alleges that contrary to these claims, the products do not work as advertised.

A few days after Slutsky purchased two Copper Chef Pans at Walmart, he says he noticed that his pans began to deteriorate. 

He claims that food began to stick to the pans after two days of use and the cookware surfaces began to change color, all the while claiming that he used the products in accordance with the instructions. Slutsky says he contacted the company and asked for a refund.

“Defendant claimed that Plaintiff Slutsky’s Copper Chef Pans were not defective; rather, Plaintiff Slutsky had failed to properly ‘season’ his pans, despite the fact Defendant’s instructions do not require ‘seasoning,’ and declined to refund Plaintiff Slutsky’s purchase price,” the Copper Chef class action lawsuit states.

Plaintiff Graeves found himself in a similar situation after purchasing three sets of Copper Chef pans from Amazon. After the pans began to deteriorate, he contacted Tristar Products by telephone and demanded warranty coverage for his products. The defendant reportedly claimed that the pans were not defective and stated that Graeves misused them.

“Simply put, Copper Chef Pans are unsuited for their intended purpose and do not live up to Defendant’s baseless marketing claims,” the Copper Chef class action lawsuit claims.

The Tristar class action lawsuit states that the company claims that its Copper Chef pans use “Cerami-Tech Non-Stick Technology” that means nothing will stick to the pan and which “provides instant food release and eliminates the need for added fats and oils.”

The plaintiffs state that contrary to the claims made on their website, the pans do not follow its various warranties, including that they last a lifetime, as they inevitably lose their non-stick functionality.

“Defendant knew, or should have known, that Copper Chef Pans are defective, unfit for their ordinary and intended purpose, and incapable of performing as warranted,” the plaintiffs allege.

In addition, the Tristar Products class action lawsuit states that the company concealed the fact that their products were defective and does not provide a refund from consumers when requested. The company claims that they do not provide a refund because their customers are not using the products according to the instructions.

The Copper Chef class action also states that Tristar Products continues to sell their non-stick pans throughout the United States at Walmart and online at Amazon while misrepresenting the performance of their products. This, the plaintiffs allege, is causing millions of dollars in damages.

The plaintiffs bring claims in violations of various states’ consumer fraud laws, breach of express and implied warranties, and violations of the Magnuson-Moss Warranty Act.

Potential Class Members include: “All persons and entities in the United States who purchased Copper Chef Pans.”

    Mine worked well for about a year of occasional use but now suddenly even buttered bread sticks! It’s terrible.

    Please add me to the class action settlement. I have the Cooper Chef 12.5 qt roaster. I barbecue some pork chops. When I wiped out the excess barbecue before I began to wash the pan, I noticed there was some rough patches in the pan. I’ve never had this problem before. The metal is no longer smooth. It’s rough now and looks like it peeled or corroded. It’s no longer usable. I Do Not use metal in my cookware. Scared that we may have injected some harmful materials. Scared to use my other Cooper chef pans, bakeware, etc.

    Add me. We bought these pans at Walmart and they are pure junk. They were not fine from the get go. The coating is not non-stick. They are horrible and food does stick. They are not as advertised on television. They are total trash junk. It would have been great if they had worked as advertised. They looked “pretty”, but they are not functional. This is sad because I bought several sets as Christmas gifts for the family. It is awful that these “gifts” are doing the same exact same thing as mine did. The food sticks to them and they are not as advertised. It is just a gimmick and a waste of good hard earned money. This is an outrage for this suit to be dismissed. How do they justify dropping the class action lawsuit when so many people bought them and so many people have the exact same problem???

    I purchased an induction cooktop with the copper chef pan. I bought it just to buy it. When I finally used it for a few times food kept sticking and burning in the middle of the of the pan and the “copper” coating is deteriorating. To me it’s a terrible product and all the infomercials are false advertisements.

    I absolutely HATE my copper pans! I seasoned them properly and also only cook with oils and butter to make sure my food doesn’t stick. No matter what you do….. EVERYTHING STICKS! They’re horrible and don’t even heat evenly. They ruin food! I’ve had to transfer my meals to my cast iron pans to try and save my meals.
    These things are horrible!
    Try cooking an egg in one…. you will not recognize it. I swear it eats the egg then mashed it up and pukes it back out.
    You can just look into the pan and it latches onto your food like a teenager who tries super gluing his hands together and then realizes that life will never be the same.
    What a complete waste of money.
    Go to a thrift store and buy an old looking pan for 25 cents and you’ll thank me later

    The first copper chef pans I bought lasted years and were great. The new ones required
    spray the first use or they wod stick

    Purchased a pan to use on an induction plate.
    This pan will not work. I called the company and they told me their pans work on an induction plate.
    This one doesn’t.

    My Fiance bought me a set of Copper Chef Cookware from Walmart. We had to return the first one because the 11″×11″ Saucepan was damaged.
    When we get back home and open the new box, the 8″ Skillet is Chipped. Walmart says that is the last and only one that they’re going to have for several months to contact the Manufacturer.
    I called Copper Chef and they told me that my First Year Warranty is through Walmart.

    My Fiance purchased a set of Copper Chef Cookware me at Walmart for Christmas a couple of years ago. I had to return the first set because of a Defect to the Large Saucepan. I get home and open the New box and the 8″ Skillet has a Chip in it, and the Chopping Knife isn’t Straight.
    Walmart said that was the last one they would have until later in the year, so I was Stuck with it. I had called Copper Chef and they said that I had to deal with the Original Merchant for the first Year.
