Family Dollar Clover Valley fudge mint cookies class action lawsuit overview: 

  • Who: Dawn Nastali filed a class action lawsuit against Dollar General Corporation. 
  • Why: Nastali claims Family Dollar misrepresents that its Clover Valley brand Fudge Mint Cookies contain dairy and mint ingredients. 
  • Where: The class action lawsuit was filed in Illinois federal court. 

Family Dollar misrepresents that its Clover Valley brand Fudge Mint Cookies contain actual fudge and mint, a new class action lawsuit alleges. 

Plaintiff Dawn Nastali claims Family Dollar misleads consumers by substituting dairy ingredients with vegetable oils to make the fudge for the cookies and by using natural and artificial flavors to give them their mint taste. 

“Defendant sold more of the Product and at higher prices than it would have in the absence of this misconduct, resulting in additional profits at the expense of consumers,” the Family Dollar class action states. 

Nastali argues reasonable consumers are “misled” by the product being named Fudge Mint Cookies and by the product’s packaging, which features a picture “of the cookies coated with what appears to be fudge.” 

A reasonable consumer would expect fudge to contain “at least some dairy ingredients,” the Family Dollar class action alleges.

Nastali argues further that the product’s green packaging with a picture of two mint leaves misleads consumers into expecting that the cookies contain mint ingredients.

Instead of actually containing mint ingredients, Nastali claims Family Dollar uses natural and artificial flavors to create the mint taste that has “no connection to mint ingredients.” 

“By not disclosing the source of the mint taste, consumers are misled to expect the presence of higher quality mint ingredients instead,” the Family Dollar class action states. 

Nastali claims Family Dollar is guilty of fraud, negligent misrepresentation and unjust enrichment and in violation of breaches of express warranty and the Illinois Consumer Fraud and Deceptive Business Practices Act.

The plaintiff demands a jury trial and requests declaratory and injunctive relief along with monetary, statutory and/or punitive damages for herself and all class members. 

Nastali wants to represent an Illinois class and multistate consumer fraud subclass of consumers who have purchased Family Dollar’s Clover Valley brand Fudge Mint Cookies. 

A consumer filed a similar class action lawsuit filed against Walmart last November, arguing its Great Value brand Fudge Mint Cookies don’t contain real mint or essential fudge ingredients
