Ensure nutrition drinks class action lawsuit overview:

  • Who: Condalisa LeGrand and Larissa Bates filed a class action lawsuit against Abbott Laboratories.
  • Why: LeGrand and Bates claim Abbott misleadingly represents that its Ensure nutrition drinks are healthy despite them adding up to 22 grams of sugar into them.
  • Where: The class action lawsuit was filed in California federal court.

Abbott Laboratories misrepresents that its Ensure nutrition drinks are healthy, despite their sugar content scientifically proving otherwise, a new class action lawsuit alleges.

Plaintiffs Condalisa LeGrand and Larissa Bates claim Abbott adds up to 22 grams of sugar into its Ensure nutrition drinks, in spite of advertising them as “Complete, Balanced Nutrition for everyday health.”

LeGrand and Bates argue Abbott’s representations of its Ensure nutrition drinks as healthy are “false and misleading” due to “a vast body of scientific evidence demonstrating that consuming sugar sweetened beverages harms rather than supports overall health.”

“In light of this sugar content and the scientific evidence, Abbott’s representations that the Ensure Nutrition Drinks are balanced, nutritious, and healthy, are false and misleading,” states the Ensure class action.

LeGrand and Bates want to represent a nationwide class and New York and California subclasses of consumers who have purchased for personal or household use any of Abbott’s Ensure nutrition drinks.

Ensure nutrition drinks allegedly not healthy due to sugar content

LeGrand and Bates claim Abbott is guilty of unjust enrichment and intentional and negligent misrepresentation, and in violation of, among other things, New York General Business Law, and California’s Consumers Legal Remedies Act

Plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and punitive damages for themselves and all class members.

The U.S. Food and Drug Administration acknowledged last month that there were shortcomings in its response to the nationwide baby formula shortage caused by a bacterial contamination at an Abbott Nutrition factory.

The plaintiffs are represented by Jack Fitzgerald, Paul K. Joseph, Melanie Persinger, Trevor M. Flynn, and Caroline S. Emhardt of Fitzgerald Joseph LLP.

The Ensure nutrition drinks class action lawsuit is LeGrand, et al. v. Abbott Laboratories, Case No. 3:22-cv-05815, in the U.S. District Court for the Northern District of California.

I was told to drink these in 2019 after I kept loosing weight after a hospitalization for COPD. Was @03 pounds couldn’t eat . My insurance paid for it finally as I couldn’t afford the 2 per day Dr wanted me to drink. I steadily gained slowly and stopped. However prior to my illness I did not eat carbs or sugar and this led me to crave sweets and carbs. I got up to 136 and started keto.in 2022.my labs during all of this showed very high sugar and ensure was all I was eating and I dint feel well.

    1. James Greene says:

I am a caregiver of my veteran brother, who is very sick, from camp lajune poisoning, he does not have any of the cancers they feel he should have in order to receive compensation, but God as my witness, I knows he is a sick 50ish year old young man, whom had a massive stroke after leaving marines, high blood, high bloodsugar, high potassium, CHF, edema can’t sleep without c-pap machine, lost of appetite, upper stomach irritation, reflux, degenerative arthritis we feel he was suffering from water& food poisoning and was not aware of the signs and with high glucose levels high potassium levels ,the contamination, was or did affect his muscle and he lost control of his ability to concentrate, became dizzy, and his ability to keep his eyes focused he lost control of his automobile and recked going 35 -40 miles per hour,,the marines said he was intoxicated, they put him out with and Honorable Discharge no compensation, under oath swore he did not have any alcohol because it was during work week and he would have never drinked while on weekly duty, they did not care, and did not try and help him by looking into it further, just put him out with broken hip and pins in hip, with no direction on what to do for doctor or medication!! I have been his caregiver for 3 yrs ,he is a very sick individual we started him on ensure few mths bac because he could not keep his food down , he was having dry heves, and diarrhea, lost of appetite, and potassium dropped to 25, BP dropped to 56 over 67 and we had to put him in hospital when he returned home we was told to give him ensure, but it would make his sugar spiral, so now I am having trouble with diarrhea and him not wanting to eat because he has diarrhea everytime he eats or drink the ensure, I don’t know what to do doctors just keep adding meds,15 pills a day!! Sincerely Seeking HELP!! Would like to be part of law suit, sorry I wrote life story, really don’t know if ensure hurt do know its not helping me, (have so many ailments)

      1. DAVID PUKA says:

So sorry to hear, as per my experience. I’d highly recommend a consult with the green bridge society, to start getting off the meds that are in fact causing most of the problems, besides the ensure. They should have sugar free in this day and age.
So me and my friend had some bad bp his high mine low. Medical marijuana helped in both instances. Me the sativa helped raise BP, naturally.
And his high BP. Was lowered by indica strain. They also have ingestible meds so nobody needs to smoke and choke.
Our medical systems are really screwed up. First is to find a good Dr who treats the patient, not the symptom. Usually when patients don’t respond well to a m d we’re told to double it, and that’s just wrong in some cases. Further study is usually needed.
The green bridge society out of Tyrone Pennsylvania. The founder is a perfect example of getting off the bad drugs.
I read your story and couldn’t help but help!
I sure hope it does! 🙏
