The latest talcum powder cancer trial against Johnson & Johnson commenced earlier this month with opening arguments from the plaintiff’s attorney stating that the company’s “love of money result[ed] in all manner of evil” for women who used its products.
Plaintiff Nora D., 56, used Johnson’s Baby Powder for personal hygiene purposes for the majority of her life and claims Johnson & Johnson is liable for her ovarian cancer diagnosis.
Her talcum powder cancer trial is the first this year against Johnson & Johnson.
Nora’s attorney told the jury that Johnson & Johnson was aware since the early 1980s that there was a link between talcum powder use and ovarian cancer.
And still to this day, “pick up a bottle of baby powder and turn it around and you will not find a warning. There will be no warning whatsoever regarding cancer,” Nora’s attorney stated. “Since 1982 at a minimum they’ve known about this directly and done nothing.”
Recent Talcum Powder Cancer Trials Yield Verdicts for Plaintiffs
Of all the cases against Johnson & Johnson, Nora’s is the fourth to go to trial before a jury, and the fifth trial overall, out of thousands of lawsuits currently pending. Up to this point, plaintiffs have prevailed in every talcum powder cancer trial, with J&J owing plaintiffs and families millions.
Three consecutive trials in 2016 against Johnson & Johnson and their talc supplier Imerys Talc America resulted in massive verdicts of $72 million, $55 million and $70 million.
The plaintiffs in the talcum powder lawsuits allege that Johnson & Johnson was aware of scientific evidence suggesting that talcum powder applied to the genital area as part of a feminine hygiene program can cause the talc particles to travel to the ovaries, causing cancer.
The plaintiffs allege that J&J placed their profits over consumer safety while purposefully concealing any warnings related to talcum powder use and ovarian cancer.
Nora stated in her lawsuit that she used Johnson & Johnson’s talc powder for the last 36 years. However, the company and its talc supplier state that Nora’s ovarian cancer was not caused by the talc product.
The companies cite hearings conducted by the U.S. Food & Drug Administration in the 1990s on the risks of talc. The FDA concluded that talc is safe and that there is no conclusive evidence of a link between talc-powder-based hygiene products and ovarian cancer.
Most lawsuits against J&J are pending in St. Louis, with about 1000 cases there, but the number of talc powder lawsuits is growing nationwide. There are consolidated talcum powder cancer lawsuits in California state court in Los Angeles, as well as in both state and federal courts in New Jersey.
A judge recently set a date for the first talcum powder cancer trial in California, and New Jersey still has yet to set a trial date.
