Equifax logo on phoneEquifax Information Services, Bank of America and General Motors Financial Company have been hit with a class action lawsuit from a consumer who claims she is a victim of inaccurate credit reporting by Equifax.

Plaintiff Bella Rabinowitv says she disputed an inaccurate item associated with Bank of America and GM Financial that appeared on her Equifax credit report on Nov. 6, 2019.

Equifax reportedly told Rabinowitv that they would investigate the dispute but failed to resolve it, so she filed a statement of dispute with the company.

The plaintiff then obtained another credit report in December 2019, and saw that Equifax had not included her statement of dispute on her updated credit report.

The Equifax class action lawsuit states that Equifax then issued consumer reports without telling the users of the reports that certain information was disputed by the plaintiff and did not include a copy of the plaintiff’s statement of dispute.

“Equifax Information Services, LLC intentionally failed to include the statement of dispute with later copies of the Plaintiff’s consumer reports,” the Equifax class action lawsuit claims.

Rabinowitv alleges that the statement of dispute letter was sent after her request for a reinvestigation displayed “no change” in the status of her credit report account.

The plaintiff says the defendants have violated the Fair Credit Reporting Act (FCRA) as she disputes the accuracy of the information on her credit file.

“Despite having furnished information from Bank of America Corporation and GM Financial and the disputes from the Plaintiff, Equifax Information Services, LLC has completely abdicated its obligations under federal and state law and has instead chosen to merely ‘parrot’ whatever its customers, Bank of America Corporation and GM Financial have chosen to say,” alleges the Equifax class action lawsuit.

The plaintiff also claims that Bank of America and GM Financial have promised to update their accounts based on the statement of dispute but have “willfully, maliciously, recklessly, wantonly, and/or negligently failed” to follow this requirement, as well as the requirements put forth by the FCRA.

The Equifax class action alleges that a furnisher is liable for its failure to participate in the investigation after it receives notice from the credit reporting agency (CRA) of the consumer’s dispute. In addition, the class action lawsuit states that a failure of the CRA to send the dispute to the furnisher would relieve the furnisher of its obligations.

“Any furnisher who negligently fails to comply with any of its investigation duties is liable to the consumer for actual damages, the costs of litigation, and attorney fees. If the violation is willful, the furnisher is liable for actual damages or minimum statutory damages between $100 and $1000, for punitive damages, as well as for costs and attorney fees,” the Equifax class action lawsuit states.

    I have tried several times to get to dispute a few things on my credit reports. And just like this lady I get the same answer, “no change”. I have struggled very hard to repair my credit after my divorce because I’ve had to start all over again. It has taken me 10 years to do it but it’s finally coming together. I still have one major problem to which I have disputed, with written notices from the courts to the creditors. It states the same….”no change” answer.

    I have been a victim of identity theft three times, and have reported it, but the things that are on my credit report, they will not take it off I have disputed it time after time and they did nothing

    I put in a lot of work to better my credit and i still have old accounts that have been paid off still on my credit report filled a dispute and they’re still therer. Help please.

    I had had wrote a letter to Equifax back 2018 to dispute 5 items off my credit report I wrote Equifax last week on Jan 29 2020 to remove items off my credit report like the items 2 First Premier Bank that was a paid $0 and Credit One Bank that was a $0 ,also 2 Verizon Fios account that was a $0 balance I had ask Equifax to remove the items off so many times ,they told me it take 7 years to stay on your report, I told Equifax it takes 30 days to remove off your credit report.

    I have had identify be theft all the way back in 2017 I report it by they still did nothing.i had a frezzer put on it but they talked to do it

    I have struggling to get my credit back in shape and they haven’t helped, nor been receptive to changed status or disputes.

    I have disputed inaccurate accounts on my credit report with them and I also seen that they re-inserted a deleted account on my credit report they always come back “account is verified ” but what you use to verify the account when requested for what was use to verify they come back ” we will not re-investage this/these account. Also accounts I have no knowledge of they have cause my credit to drastically damaged.

    I have inaccurate charges on my credit report that I have disputed with Equifax many times. I get the same answer from Equifax each time I dispute. They tell me that the company that I am disputing the charges with that their information is correct. Well that is not accurate. I was renting a subsidized apartment in 2015. My lease was for six months. I got the news, in September, from my doctor, that I had breast cancer. I also needed to take care of my 18 month old granddaughter while her father went to rehab for a year. I was 66 years old and needed help to get thru the next 6 months so I moved in with my daughter. My lease was up in a couple weeks when I told the apartment manager about my situation. I had my surgery in September 2015. My son went to rehab in October 2015. It was almost impossible to ever find anyone in the office of the apartment complex. So the manager said just to email her. So I did and she approved my leaving a few weeks before my lease was up. When I moved I left the apartment clean. I also gave up my deposit because I had to move out early with the apartment managers approval. I never heard anything about owing anything to Rent Automated Collections until June 2018 when I saw this on my Equifax credit report. The charges were $2084.00. I wondered what are they charging me this money for because I never received any kind of bill or notice. I have disputed this over and over again with the same results. I have been paying Equifax $19.99 a month for over a year. I know what they are trying to charge me with is bogus. Just made up charges.

    I have inaccurate charges on my credit report that I’ve dispute multiple times because I had no knowledge of the account. These things have caused me to lose my good credit score and I’m being billed for something I knew nothing about.
