Loomis Armored US LLC has agreed to pay $1.5 million to resolve claims that they did not pay their employees the overtime wages they were owed.
The settlement benefits current and former service technicians who worked for Loomis in North Carolina between Oct. 1, 2015 and Dec. 16, 2019 who were not paid overtime wages.
Plaintiff Shakeera Myers, who formerly worked for Loomis as an armored service technician, claims that she and other ASTs were denied overtime pay.
According to Myers, the company violated the federal Fair Labor Standards Act and North Carolina labor law by failing to compensate its employees for hours worked.
Myers claimed that she and other employees were not consistently paid overtime for hours worked over 40 in a single workweek. At times, she was reportedly paid one and a half times her regular hourly rate, but at other times she was allegedly paid only one-half times her regular rate.
The Loomis suit, which was filed as a collective action under federal law and a class action under North Carolina law, sought unpaid wages, damages, interest, court costs, and attorneys’ fees.
Loomis has not admitted any wrongdoing but has agreed to settle the claims against them by paying $1.5 million.
The settlement will cover all allegedly unpaid wages, including unpaid overtime. Payment amounts will vary depending on the wages owed to Class Members under the terms of the settlement. Payment amounts are reportedly included on claim forms sent to Class Members, although payments may be larger.
In order to benefit from the settlement, Class Members need to submit a valid claim form by March 22, 2020. Class Members are also required to submit an IRS Form W-9 by this date. Both forms should be returned to the settlement administrator or electronically uploaded.
The deadline for exclusion and objection is March 22, 2020. The final approval hearing for the Loomis unpaid overtime class action settlement is April 8, 2020.
Who’s Eligible
FLSA Collective Members: current and former service technicians who worked for Loomis in North Carolina between Oct. 1, 2015 and Dec. 16, 2019 who were not paid overtime wages.
Rule 23 Settlement Class Members: current and former service technicians who worked for Loomis in North Carolina between Oct. 1, 2016 and Dec. 16, 2019 who were not paid overtime wages.
