More than 1,200 first responders have joined a class action lawsuit filed against Honolulu and Maui County officials, claiming a COVID-19 vaccine requirement put in place violates their civil rights.
The class action lawsuit was filed in federal court Friday by a dozen plaintiffs, including firefighters, police officers, and other first responders. The plaintiffs want to stop Hawaii Governor David Ige, Honolulu Mayor Rick Blangiardi, Maui Mayor Michael Victorino, and United States Secretary of Health and Human Services Xavier Becerra, among others, from enforcing a vaccine or testing mandate announced recently.
The plaintiffs are suing under The Civil Rights Act of 1871, which allows people to sue the government for violations of civil rights. They’re alleging the defendants deprived them of their constitutional rights to due process in violation of the First, Fourth, Fifth, and Fourteenth Amendments of the United States Constitution with a vaccine requirement that was announced last week.
The plaintiffs want to represent first responders from the Honolulu Fire Department, the Honolulu Police Department, the Maui Fire Department, the Maui Police Department, the Honolulu Emergency Medical Services Department, and the Honolulu Ocean Safety Department.
They say implementing a vaccine mandate is a violation of their civil rights and their collective bargaining agreement, Hawaii Revised Chapter 89.
Governor Ige issued a statement last week that all state and county workers would need to get the COVID-19 vaccine or submit to weekly testing beginning on Aug 16, and that refusal to do so could be grounds for termination.
The announcement drew the ire of workers’ unions, which claimed the plan was not appropriately discussed with them ahead of time. The plaintiffs say it should be up to them to make the decision on whether or not to take the vaccine, and that their employment status should not be threatened.
“Governor Ige has callously and recklessly disregarded these long standing principles and entered an Emergency Proclamation suspending Hawaii Revised Chapter 89, thereby leaving Plaintiffs no other avenue of relief other than the federal court to enforce their clearly established federal statutory and constitutional rights,” the class action lawsuit says.

It’s NOT a Vaccine, yet even if your jabbed you still have to wear a mask?? Hush your ignorance! My Aunt was a RNMN at Children’s Hosp of L.A. all her life. Wearing a mask does Nothing to stop transmission! N95 is a joke as vaporized particles can not be stopped from a mask There is NO way to stop the virus, it is here to stay just like the flu. Your hands touch everything and unless you sanitize those hands every single time you touch anything anywhere, you will transmit regardless of a mask. Anyone can be the smartest person alive, but common sense is Real!

This lawsuit is absolutely silly.
It is exactly same, like where can you smoke. If you smoke next to me, you make danger for my and my family members’ health. If you don’t vaccinate, then you influence my and my family members’ health.
Any body breathing next to you is dangerous for your health. Whether they are vaccinated or not. We are all walking petri dishes of bacteria. So if you knew what you were talking about you would realize that your well being is not anybody else’s responsibility. It is only yours!
You make no sense as it’s already been proven that just bc you’re vaccinated doesn’t mean you can’t get it. I know plenty of people who are vaccinated and still got covid. Wake up people!!!! Forcing this on you is against your rights!!!! Fight against it

That my dear depends on the state and their labor laws. Not all states are so called “at will”. And if you can prove that you were wrongly terminated than yes you do have a law suit
I don’t want the vaccine but I would opt for a test every week. I would prefer an oral test as opposed to sticking something up my nose.

It’s already been proven that just bc you get the vaccine doesn’t mean you can’t get the virus and transmit it to others. Do you not pay attention? People are dying in the state of Florida after receiving the vaccine and others that have received the vaccine a few months ago are getting sick and testing positive for COVID. Making the vaccine mandatory just violate our constitutional rights and our freedoms. It’s not right. Unethical. Why send our soldiers to die for freedoms that we apparently don’t even have if we can’t even choose if we want to be vaccinated with a death shot or if we want to take our chances. I understand that people are spreading the virus due to failure to follow cdc protocol but when people are dying due to the shot as well as the virus, what good will it do? Either way people are dying. I think if this becomes 100% mandatory for the entire US, there is going to be a massive uprising of the people, another civil war will start, people will be rioting once again at the capital and the president may end up being impeached. It’s a terrible idea as well as one big problem waiting to happen. I hope our government think about this before they push a mandatory vaccination
Nearly 15,000 have died from the vaccine and that is not estimating the under reporting. Also the side effects are devastating!
