Canon class action overview: 

  • Who: Plaintiff Christopher Bozyk filed a class action lawsuit against Canon USA, Inc. 
  • Why: Bozyk claims that the Canon all-in-one printers require expensive ink cartridges to complete functions such as scanning and sending a fax even though ink isn’t required for those functions.
  • Where: The Canon all-in-one printers class action was filed in federal court in New York.

Plaintiff Christopher Bozyk filed a class action lawsuit against Canon USA because the company’s all-in-one printers cannot perform the functions of scanning or sending a fax without an ink cartridge.

The lawsuit says it is a design flaw that Canon printers require purchase of an ink cartridge if ink is low in order to scan a document.

“Canon does not represent or warn consumers that ink is a necessary component in order to scan or fax documents,” the Canon printers class action says. “Nor would reasonable consumers have such an expectation, as ink is not necessary for scanning or faxing. As a result, consumers are forced to incur unexpected and unnecessary burden and expense in the form of ink purchases or in the alternative be unable to scan or fax documents using the so-called ‘all-in-one’ device.”

Canon knew about ink issue with all-in-one printers as early as 2015, Canon class action claims

Canon knew about the scanning issue as far back as at least 2015 and the company responded to comments about the issue on its own website. The issue has led the plaintiff to claim that calling the printer all-in-one without warning customers before the purchase is false advertising and a deceptive business practice.

The class is asking for damages, along with interest and attorney’s fees, for those who are part of the class who purchased the all-in-one printers.

In 2021, Canon faced a similar class action lawsuit claiming the company’s “all-in-one” printer, fax machine and scanner wouldn’t let users scan or fax unless they’ve loaded the machine with expensive ink cartridges.
