Ultra music festival no refund policy has led to a class action lawsuit.

A woman who spent more than $1,000 on two tickets to a canceled 2020 music festival wants her money back, and she’s filed a class action lawsuit to get it.

Florida’s Gabrielle Petroka lodged the lawsuit on March 31 against the organizers of Miami’s 2020 Ultra Music Festival and the City of Miami, alleging Event Entertainment breached its contract with customers when it refused to refund tickets to the event.

The event, marketed as the “world’s premier electronic music festival,” was meant to go ahead from March 20-22, featuring headliners Boys Noize and Flume. However, like many other events, it was canceled due to the pandemic.

Petroka says after the event was canceled, Ultra Music Festival did not issue refunds to its customers, and instead tried to offer transfers of the tickets for 2021 or 2022 events, with “upgrades.” 

However, choosing this option prompted ticket holders to check a box accepting new terms and conditions. Hidden in the terms and conditions, she alleges, was a promise to waive recovery of attorney fees or costs in litigation, not to attempt any credit card chargeback and a waiver of certain legal defenses. 

Petroka, who spent $1,032 on two tickets to the festival, called Ultra Music Festival’s actions “repugnant” and “deceptive.”

“This action stems from Event Entertainment Group’s cancellation of the 2020 Ultra Music Festival… and [its] repugnant decision to keep all of the money paid by ticket holders — including [Petroka’s]— indefinitely and without refund,” the lawsuit states.

Petroka said the company told ticket holders that the event was postponed, not canceled, despite filing lawsuits against its vendors saying it should be refunded for equipment because its event was canceled. There is no 2021 event going ahead.

Petroka is seeking to represent a Class of Florida residents who bought tickets to the 2020 Ultra Music Festival. She’s suing the promoter of the festival for violating state laws including breach of contract, negligent misrepresentation, deceptive trade practices and unjust enrichment. 

The City of Miami is charged with civil conspiracy, and Petroka asks the court to block Miami from leasing city property to Ultra for the event as long as it continues to engage in activity alleged in her lawsuit.

She’s asking for a judge to issue an injunction halting Ultra from selling tickets for music festivals, plus fees, costs, her refund and a jury trial.

This lawsuit is the latest lodged against Event Entertainment over the refund denials. In May 2020, a Miami man sued the company after purchasing six tickets to Ultra Music Festival 2020 for around $3,000 that he wasn’t able to get a refund for.

    Do you know whom should I contact to get my refund? I created multiple cases on their website and have not received any response. I chose the 2021 and I won’t be able to go in 2022. I got 2 tickets back for 2020 and they are keeping 1023.30
