A Thunder on the Mountain Music Festival has been reached to resolve cancellation claims.

Music concert goers have secured a $450,000 settlement agreement over a 2015 cancelation of Thunder on the Mountain music festival in Arkansas.

Those who may benefit from the settlement include those who purchased any number of passes for the Thunder on the Mountain music festival that was to be held in June 2015 in Ozark, Ark., along with those who purchased vendor booths who did not receive reimbursement for their purchase.

The Thunder on the Mountain country music festival was scheduled for June 26-28, 2015. However, on June 13, the organizers announced that the event was cancelled. The cancellation was attributed to “events beyond our control,” according to event organizers.

The Thunder on the Mountain music festival class action lawsuit was filed on behalf of those who purchased day passes, children passes, VIP passes, camping passes, RV passes, hotel passes or packages, reserved seating, shower passes, passes of any other kind, or vendor booths to the event. Allegedly, a number of those who made these purchases did not receive a refund for their tickets from the event organizers, including The Madison Companies LLC and Horsepower Entertainment LLC.

The lead plaintiff, Michael Florence, claimed that he purchased four three-day passes to the Thunder on the Mountain country music festival, along with a reserved campsite and four reserved seats in 2014. Though the plaintiff paid nearly $3,000 for the passes and seats, he says that he never received a refund for his purchase.

According to the complaint, issues between the event organizers, including the defendants and Pipeline Productions and Backwoods Entertainment, arose in 2014, putting the Thunder on the Mountain music festival on “very shaky ground.” These issues were not made public, alleged the plaintiff, making it impossible for him and other Class Members to know that there was a good chance the event would be cancelled.

Despite these issues, including tensions between the event organizing companies regarding legal agreements, passes reportedly continued to be advertised and sold.

The Thunder on the Mountain music festival class action lawsuit alleges that the event was ultimately cancelled due to a failed agreement between the event organizers that occurred in May 2015. The event was cancelled just two weeks before it was scheduled.

The complaint alleges that one of the event organizers, Horsepower, retained the plaintiffs’ and other Class Members’ payments for passes to the music festival. In addition, the plaintiff accused the event organizers of concealing the increasing animosity and break down of legal agreements that put the Thunder on the Mountain music festival in peril and ultimately lead to its cancellation.

A separate partial settlement agreement was reached with Pipeline Productions and Backwood Entertainment, with these event organizers agreeing to pay a portion of the Thunder on the Mountain music festival class action settlement. Pipeline and Backwood also filed a lawsuit against the other Thunder on the Mountain organizers, Horsepower Entertainment and The Madison Companies in Kansas court, and won a judgment, eventually leading to another settlement agreement.

Under the terms of the Thunder on the Mountain settlement agreement, the parties have agreed to cease any post-trial motions and appeals in the other proceedings and effect a settlement with Class Members amounting to $450,000. This settlement fund will provide payments to Class Members, though more details are not currently available.

Class Members can make a claim either online or by mail. Class Members must provide a Notice ID and Confirmation Code to make a claim online. Alternatively, Class Members can either contact the settlement administrator or print a claim form to send by mail. Claim forms sent by mail must include proof of purchase. All claims must be filed by Dec. 22, 2020.

The deadline for Class Members to exclude themselves or opt out of the Thunder on the Mountain music festival class action settlement is Aug. 10, 2020. The final approval hearing is scheduled for Aug. 18, 2020.

Who’s Eligible

Consumers who purchased passes or vendor booths to the 2015 Thunder on the Mountain Music Festival who did not receive a refund or chargeback for their purchase. Passes include day passes, children passes, VIP passes, camping passes, RV passes, hotel passes or packages, reserved seating, shower passes, passes of any other kind, or vendor booths.

Potential Award

Varies. 

The terms of awards to Class Members are not currently disclosed, but affected consumers who file a claim will be able to recover payments from the $450,000 settlement.

Proof of purchase is required for mailed forms. Notice ID and Confirmation Code are required for online claims.
