Candy Dynamics Inc. is facing a class action lawsuit claiming it uses deceptive business practices in the sales and marketing of its recalled Slime Liquid Sour Rolling Liquid candies, which are a candy choking hazard.

This comes after Candy Dynamics recently announced a recall of around 70 million of its Slime Licker Sour Rolling Liquid candies over concerns a rolling ball in the products’ containers could detach inside a child’s mouth, posing a candy choking hazard for children.

Candy Dynamics was unjustly enriched due to selling hazardous products, the Slime Liquid candy class action claims.

“Plaintiff and those similarly situated purchased the products so that their children could enjoy a sweet treat, and believed that the products were safe for human consumption and free of choking hazards; however, the products container contains a rolling ball that runs the risk of detaching from the product’s container and causing a consumer to choke,” the candy class action says.

Slime Liquid profits should be returned to consumers, class action says

Plaintiff Sonia Cauchi and her lawyers are asking for monetary and punitive damages, as well as attorneys’ fees and expenses.

The proposed classes include a nationwide class and a New York subclass. The class action seeks to have the profits Candy Dynamics made from selling the recalled candy put into a trust and given back to consumers in the form of restitution.

There were at least two reports of the rolling ball detaching, which could lead to choking or asphyxiation due to consuming a product marketed toward children, the candy class action claims.

    I didn’t know these have been recalled. I just bought one for my daughter yesterday. And while she was eating it the ball fell out and spilled the almost full bottle of candy all over her and the floor. Why are they still selling this product if it has been recalled?!?!
