Best Buy uses its โPrice Match Guaranteeโ to bait-and-switch consumers into purchasing products from its retail stores, a new class action lawsuit alleges.ย
Plaintiff Vincent Dima claims Best Buy is not a โmagnanimous retail seller doing right by its sellersโ but rather simply โtrying to make the proverbial extra buck through specious trade practices.โย
Dima argues Best Buy โmaintains an unstated policy, practice and/or procedure of not honoringโ its price match guarantee when a customer requests it โmatch a specific designated online and/or local competitorโs lower price.โย
โPlaintiff and the class have been damaged by BEST BUYโs policy, practice and/or procedure, and its failure to comply with its own โPrice Match Guaranteeโ regarding its list of designated online and/or local competitors,โ the Best Buy class action states.ย
Dima wants to represent a New York class of Best Buy customers who have been denied the monetary benefits of the companyโs guarantee โinvolving specific designated online and/or local competitorsโ it lists.ย

The plaintiff claims that, when he brought his concerns about the price match guarantee to Best Buy, the company simply โaltered its own list of designated online and/or local competitors covered by the โPrice Match Guarantee.โโย
Best Buy is accused of unjust enrichment and of violating New York General Business Law. He is demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory damages for himself and all class members.ย
The class action lawsuit comes nearly one year after Best Buy recalled around 635,000 of its Insignia air fryers and air fryer ovens over concerns they could overheat and pose a fire and burn hazard.ย

I had a BB credit card and went in to buy a phone. They were out of the phone in the ad everywhere and told it likely wouldnโt be in stock again as the new model was coming in. That said, they wouldnโt take the phone or the great sales price off their display either. If you donโt carry it, why have it out? If itโs likely never coming in again, why have it out? Just to show you have it on sale and get peopleโs hopes up? Had to buy a different one (bait & switch) and that one came with so many problems and they lied about certain features of it. I had to get rid of it earlier than I wanted to. They also baited me to buy the Zagg screen protector promising us that if at ANY time it needed to be replaced, I should bring it in and theyโd give me another one and even put it on for me. All for free after initial purchase. Sounded great, but 6 months after purchasing first one, I needed a new screen protector and they were out of stock. Not just out of stock in the store, but also throughout the entire BB system. Itโs been TWO YEARS and theyโve never got that screen protector back in the store. I had to go to Zagg directly and pay for the delivery of one to replace broken one. A charge I shouldnโt have had to cover. Just another lie to bait you into buying a phone. Iโll never buy a phone at BB again. We had a credit card and dumped it. Horrible customer service.
