  • Coca-Cola told U.S. District Judge Nelson S. Roman the plaintiffs failed to show the PFAS are dangerous in trace amounts, Law360 reports.
  • The plaintiffs claimed the tropical juice is mislabeled as natural when it actually contains PFAS chemicals.
  • Coca-Cola claims the plaintiffs lack standing to assert the claims and failed to state a claim the judge could determine to be true and then grant relief.

Simply Tropical juice is labeled as “all natural” but it actually contains synthetic “forever chemicals,” a new class action lawsuit alleges. 

Plaintiff Joseph Lurenz filed the class action complaint against The Coca-Cola Co. and The Simply Orange Juice Co. on Dec. 28 in a New York federal court, alleging violations of state and federal consumer laws.

The companies make the Simply Tropical juice drink, which, according to the complaint, is prominently labeled as an “All Natural” drink. 

“In reality, Plaintiff’s testing has revealed that the Product contains per- and polyfluoroalkyl substances, a category of synthetic chemicals that are, by definition, not natural,” the lawsuit states.

PFAS are a group of synthetic, man-made, chemicals known to be harmful to both humans and the environment, the lawsuit states. Because PFAS persist and accumulate over time, they are harmful even at very low levels and known as “forever chemicals,” the lawsuit says.

Lurenz said his independent testing revealed the juice product marketed as “healthy and all natural” actually contains the toxic chemicals. 

Despite this, the Simply brand is uniformly marketed as being transparent, natural, simple in order to gain the trust of consumers who reasonably believe that the product is free from synthetic, artificial, or unnatural ingredients which may be harmful to human health, he says.

“As a result of Defendants’ misconduct, Plaintiff and putative Class Members have suffered injury in fact, including economic damages,” the lawsuit states.

Lurenz is suing on behalf of anyone who bought Simply Tropical juice in the United States, plus a New York subclass.

He’s suing for breach of warranty, breach of New York consumer laws, fraud, and unjust enrichment. Lurenz seeks damages, fees, costs and a jury trial. 

Meanwhile, Coca-Cola deceives consumers by making it seem as if its Topo Chico Margarita Hard Seltzer has tequila in it when it does not, another recent class action lawsuit alleges.
