Best Buy price match class action lawsuit overview:ย

  • Who: Vincent Dima filed a class action lawsuit against Best Buy Co. Inc.ย
  • Why: Dima claims Best Buy fails to honor the โ€œPrice Match Guaranteeโ€ it offers to its customers.
  • Where: The class action lawsuit was filed in New York federal court.ย
  • What are my options: Microsoft carries many options when it comes to consumer electronics.

Best Buy uses its โ€œPrice Match Guaranteeโ€ to bait-and-switch consumers into purchasing products from its retail stores, a new class action lawsuit alleges.ย

Plaintiff Vincent Dima claims Best Buy is not a โ€œmagnanimous retail seller doing right by its sellersโ€ but rather simply โ€œtrying to make the proverbial extra buck through specious trade practices.โ€ย

Dima argues Best Buy โ€œmaintains an unstated policy, practice and/or procedure of not honoringโ€ its price match guarantee when a customer requests it โ€œmatch a specific designated online and/or local competitorโ€™s lower price.โ€ย

โ€œPlaintiff and the class have been damaged by BEST BUYโ€™s policy, practice and/or procedure, and its failure to comply with its own โ€˜Price Match Guaranteeโ€™ regarding its list of designated online and/or local competitors,โ€ the Best Buy class action states.ย

Dima wants to represent a New York class of Best Buy customers who have been denied the monetary benefits of the companyโ€™s guarantee โ€œinvolving specific designated online and/or local competitorsโ€ it lists.ย

Best Buy โ€˜alteredโ€™ list of competitors covered by price match guarantee when confronted with concerns, class action says

The plaintiff claims that, when he brought his concerns about the price match guarantee to Best Buy, the company simply โ€œaltered its own list of designated online and/or local competitors covered by the โ€˜Price Match Guarantee.โ€™โ€ย

Best Buy is accused of unjust enrichment and of violating New York General Business Law. He is demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory damages for himself and all class members.ย

The class action lawsuit comes nearly one year after Best Buy recalled around 635,000 of its Insignia air fryers and air fryer ovens over concerns they could overheat and pose a fire and burn hazard.ย

The plaintiff is represented by Joseph K. Jones and Benjamin J. Wolf of Jones, Wolf & Kapasi LLC.ย

The Best Buy price match class action lawsuit is Dima, et al. v. Best Buy Co. Inc., et al., Case No. 7:23-cv-02869, in the U.S. District Court for the Southern District of New York.

I have always got price matches from Best Buy when it qualified under their policy which seems to include certain retailers (online and physical stores and exclude certain others). The only thing suspicious is the list of included and excluded stores.
