Redken dry shampoo benzene class action lawsuit overview: 

  • Who: Eileen Hirsch filed a class action lawsuit against L’Oreal USA Inc. 
  • Why: Hirsch claims L’Oreal manufactured, distributed, and sold Redken brand dry shampoo products containing dangerously high levels of benzene, a known human carcinogen.
  • Where: The class action lawsuit was filed in Illinois federal court. 

L’Oreal USA manufactures and distributes and sells Redken brand dry shampoo products that contain dangerous high levels of the cancer-causing chemical benzene, a new class action lawsuit alleges. 

Plaintiff Eileen Hirsch claims the alleged high level of benzene in the Redken dry shampoo products makes them “adulterated and misbranded, and therefore illegal to sell under both federal and state law.” 

L’Oreal, meanwhile, misrepresents its Redken brand dry shampoo product by allegedly failing to list benzene among the products active and inactive ingredients, the Redken class action alleges. 

Hirsch argues further that, as a result of their allegedly high levels of benzene, L’Oreal’s Redken brand dry shampoo products are “unsafe and illegal to sell under federal law, and therefore worthless.” 

“These Products are not designed to contain benzene, and in fact no amount of benzene is acceptable in dry shampoo products such as the Products manufactured, distributed, and sold by Defendant,” states the Redken class action.

Hirsch wants to represent a nationwide class and a subclass of consumers from multiple states who purchased L’Oreal’s Redken brand dry shampoo products for personal or household use within the applicable limitations period. 

The presence of allegedly high levels of benzene in the Redken dry shampoo products came to light following testing conducted by Valisure, an independently analytical pharmacy, according to the Redken class action. 

L’Oreal is accused of fraud and unjust enrichment, and of violating several states’ consumer fraud acts along with the Illinois Consumer Fraud and Deceptive Trade Practices Act

A number of beauty companies faced either class action lawsuits or recalls last month over issues revolving around safety and privacy, including L’Oreal, Too Faced, Smashbox, Estee Lauder, and Bobbi Brown.
