Free trial logo on laptopA recent Nuvega Lash class action claims that consumers are unwittingly charged for eyelash growth serum after signing up for a free trial.

Plaintiff Cindy Adam claims that she signed up for a “free trial” of Nuvega Lash in late August 2017.

In addition to two “free samples,” Adam reportedly purchased one product for around $15.

On the same day, she says she was billed multiple times for the Nuvega Lash products in the form of two charges around $5 and one charge around $15.

In early September, she was allegedly billed again for the products as part of an automatic renewal program she claims to not have signed up for.

Adam says she received a $92.94 charge on Sept. 6 which was disputed and reversed on Sept. 8. On the day of the reversal, she was reportedly hit with another $92.94 charge from Nuvega Lash. She says that these charges resulted in a $34 non-sufficient funds fee being charged by her bank.

Although the $92.94 charge was temporarily reversed on Sept. 11, Adam says her bank reinstated the charge in late October after an investigation. According to the Nuvega Lash class action, the company made “false statements” to Adam’s bank which resulted in the reinstatement.

“While she received a partial reversal of some of the charges from her bank, ultimately she was unable to recover all of the money taken from her by the Defendants,” the Nuvega Lash class action lawsuit notes.

Adam also claims that Nuvega Lash refused to refund her for the charge. When she spoke to a Nuvega Lash representative, Adam was allegedly told that she agreed to be charged the full amount for the products if she kept the “free samples.” She argues that she never agreed to this.

Nuvega Lash reportedly agreed to refund her if she shipped the products back, but she declined the offer because she “understandably did not trust the company which had just fraudulently charged her credit card without consent.”

Her Nuvega Lash class action claims that this was the right move, with other consumers reporting a lack of refund even after sending the products back.

“They never would have refunded the money anyway—this was yet another stalling tactic the Defendants frequently used in the hopes that their victims would give up and go away,” the Nuvega Lash class action lawsuit alleges.

Adam argues that she did not consent to a renewing subscription through Nuvega Lash. Upon further investigation, Adam reportedly discovered that other consumers had been subjected to similar issues. Consumers reported their experiences to the Better Business Bureau, allegedly painting a picture of fraud and deception.

The Nuvega Lash class action lawsuit aims to hold companies and their operators responsible for this alleged scheme which Adam says caused her and other consumers financial injury.
