Neutrogena Benzophenone Class Action Lawsuit Overview: 

  • Who: Jonathan Horowitz and Dalit Cohen lobbied a class action lawsuit against Neutrogena Corporation. 
  • Why: Horowitz and Cohen claim Neutrogena sells its Healthy Skin Firming Cream With Broad Spectrum (SPF 15) containing the harmful, cancer-causing chemical benzophenone.
  • Where: The class action lawsuit was filed in California federal court.

Neutrogena sold Healthy Skin Firming Cream with Broad Spectrum (SPF 15) containing benzophenone, a known carcinogen, a new class action lawsuit alleges. 

Plaintiffs Jonathan Horowitz and Dalit Cohen claim Neutrogena fails to disclose to consumers that its product contains the harmful chemical, which they claim is also an endocrine disrupter. 

Horowitz and Cohen say they purchased the affected product without knowing that it contained benzophenone, which they allege occurs after octocrylene in the product degrades, citing studies and their own independent testing. 

California Proposition 65 determines there is “no safe harbor for benzophenone in any personal care products, including sunscreens, anti-aging creams and moisturizers,” according to the class action lawsuit. 

Neutrogena Should Have Known About Benzophenone Contamination, Lawsuit States

Despite the alleged dangers of its Healthy Skin Firming Cream with Broad Spectrum (SPF 15), Neutrogena advertises to consumers that “safety is paramount” when choosing what to put in their products. 

“Based on its stated commitments, Defendant either knew or should have known that the Product contains benzophenone and that the octocrylene in the Product degrades and produces an accumulation of benzophenone,” the lawsuit states. 

Horowitz and Cohen claim Neutrogena is in violation of California’s Consumer Legal Remedies Act, False Advertising Law and New York General Business Law

Plaintiffs demand a jury trial and request relief in the form of restitution along with compensatory, punitive, actual and statutory damages for themselves and all class members. 

Horowitz and Cohen want to represent a nationwide class and New York and California subclasses of consumers who purchased the Neutrogena Healthy Skin Firming Cream with Broad Spectrum (SPF 15) for personal use. 

Neutrogena is also part of a number of ongoing class action complaints concerning the presence of benzene, another known human carcinogen, being found in a number of cosmetic, suncare, deodorant and body spray products, among others.
