An Illinois man says he and other consumers were duped by the makers of Murad Clarifying Oil-Free Water Gel because their products are not, in fact, oil-free.
Lead plaintiff John Daly claims the product contains two oils, dimethicone and polyisobutene; however, advertising and, indeed, even the name of the product — Murad Clarifying Oil-Free Water Gel — mislead consumers into thinking the product is oil-free.
According to its website, Murad is sold on Amazon and other online retailers, as well as Macy’s Sephora, Massage Envy and Nordstrom.com.
Daly says he purchased Murad products most recently in November 2020. He claims he relied on advertising indicating the products were “oil-free.”
“By making false and misleading claims about the qualities of its products, Defendant impaired Plaintiff’s ability to choose the type and quality of products he chose to buy,” the class action lawsuit alleges.
Oil, the complaint explains, is a term that can be used to describe a number of materials. Oil is both hydrophobic and lipophilic. Two types of oils are used in Murad products, claims the plaintiff — the polysiloxane dimethicone and an alkene polymer polyisobutene.
“All of the Products contain oils, but Defendant intentionally advertise and label the Products as oil-free.”
The plaintiff contends that, in order to understand Murad products contained these oils, he and other consumers would have to have an advanced understanding of chemistry.
Instead, the products are labeled as “oil free,” tricking consumers into purchasing Murad over other products.
“Plaintiff and the Class were deceived into paying money for products they did not want because the Products were labeled as oil free,” the class action lawsuit argues. “Worse than the lost money, Plaintiff, the Class, and Sub-Class were deprived of their protected interest to choose the type and quality of products they use on their bodies.”
The complaint points out the manufacturer employs professional chemists to create its products and these employees knew or should have known that there is oil in the products the company labels as “oil-free.”
The plaintiff seeks to represent a nationwide Class of consumers who purchased Murad products in the past four years. In addition, the plaintiff seeks to represent an Illinois subclass.
The Murad class action lawsuit accuses the manufacturer of fraud, unjust enrichment, breach of warranty and of violating Illinois consumer protection and business laws. The plaintiff is seeking damages for himself and on behalf of Class Members, as well as a court order stopping the alleged false advertising of Murad products in the future.

I use this and one other company. I have noticed since using this product my skin is breaking out more and is much more oilly. I always look for products that won’t add oil to my face. This has been breaking me out alot.
