UPDATE 2:

  • This case was dismissed March 23, 2022.

UPDATE:

  • The OGX shampoo lawsuit has been making its way through the court with the plaintiff filing an amended complaint recently.
  • The class action lawsuit seeks to represent consumers who purchased various OGX hair products, including OGX Biotin+ Collagen Shampoo or Conditioner, OGX Renewing Argan Oil of Morocco Shampoo or Conditioner, Extra Strength Hydrate & Repair and Argan Oil of Morocco Shampoo or Conditioner, OGX Ever Straightening and Brazilian Keratin Therapy Shampoo or Conditioner, OGX Quenching + Coconut Curls Shampoo or Conditioner, along with others.

The OGX-brand shampoos and conditioners marketed by Johnson & Johnson to nourish and smooth your hair actually contain a combination of ingredients that cause significant hair loss, a new nationwide class action lawsuit alleges.

Plaintiff Larissa Whipple filed the class action lawsuit against Johnson & Johnson Consumer Inc. Monday in an Illinois federal court, alleging violations of state and federal laws.

Whipple says she bought OGX shampoo and conditioner because of Johnson & Johnson’s “false representation” that they would smooth, nourish, soften, repair, and revive her hair.

What wasn’t disclosed is that OGX hair products also include an ingredient or combination of ingredients that causes significant hair loss and scalp irritation upon proper application, she says.

“At least one ingredient in the Products, DMDM hydantoin, is a formaldehyde donor known to slowly leach formaldehyde when coming into contact with water,” Whipple says.

“Formaldehyde is a well-known human carcinogen that can cause cancer and other harmful reactions when absorbed into skin.”

The OGX products class action lawsuit says DMDM hydantoin has been used as a preservative in Johnson & Johnson products for well over a decade. However, it says the use of DMDM hydantoin as a preservative creates an unnecessary risk, because safer natural alternatives exist.

“As such, the Products are rendered dangerous and unsafe for sale as over-the-counter hair smoothing shampoo products,” says the OGX shampoo lawsuit.

Whipple says Johnson & Johnson failed to properly warn consumers of the dangers associated with using such a strong ingredient on their hair and scalp, even though it knew the risks.

“Defendant continued to conceal the dangers of the Products by failing to appropriately and fully recall the Products, by continuing to claim the Products were safe when properly applied, and by failing to warn consumers of the dangers attendant to the Products’ use,” alleges the OGX shampoo class action.

The plaintiff says, instead, Johnson & Johnson says OGX hair products contain special formulas intended to nourish and revive damaged or dry hair. She says she and thousands of other customers have experienced hair loss and scalp irritation as a result of the false misrepresentations.

Whipple is seeking to represent anyone in the United States who bought OGX shampoo and conditioner products, plus a consumer fraud multistate subclass and an Illinois Subclass.

She is suing for violation of state consumer fraud acts, Illinois consumer laws and unjust enrichment and seeking certification of the class action, damages, restitution, an injunction, a recall of all the OGX hair products and a jury trial.

American multinational corporation Johnson and Johnson is a household name, known for developing numerous consumer products, medical devices and pharmaceutical items that frequent the shelves of department stores. Many of the company’s products have been reported by consumers as being faulty or hazardous, leading to a range of class actions lawsuits being filed.

Johnson and Johnson is not the only company who has been targeted with such class action lawsuits. In June, a Unilever class action lawsuit was filed for similar hazardous products issues with its Suave haircare products. A class action lawsuit was also filed against Mane ‘n Tail products for ingredients which allegedly led to scalp irritation and other problems.

  1. Divya says:

I used OGX Argon Oil of Morocco shampoo 4 times in past 2 weeks. My hair started falling from the next day after my first use. Hair fall rate increased and I counted 650+ hairs fallen after last wash. I baught the shampoo as I liked the pleasant aroma, but I am never using it again. Really disappointed and feeling betrayed by all the claims of smooth shiny hair by OGX. I have always been in love with my thick long healthy hair. It is becoming so thin that I will have to cut my hair short.

  2. Sandra Mackey says:

I’m so upset.Im 64 .My hair has been falling out almost as fast as it did six years ago with cancer treatments.I have been using OGX thick and full shampoo and conditioner for a year….I’m so mad….how dare a company continue to make harmful products.I will not dare use it again after reading this article.Shame on you Johnson and Johnson. If I can sue you I sure will.My hair came back beautiful after chemo and now you took it.☹️

  3. Lisa Bishop says:

I have used the OGX Biotin Shampoo and Conditioner and also Coconut Shampoo. I did not know until today, that there was a problem. But I had started noticing a really thin almost bald spot in the back of my hair. I knew that I was seeing so much hair loss after using when I combined out after shampooing. Then in the last couple weeks I have a score scalp and a large knot in the back of my scalp since the last shampoo 1 day ago with the OGX Coconut Shampoo. I decided to do some research and here you are with others with the same issues. I will throw away the remaining OGX products I have and never use again. I just hope my scalp heals and my hair starts growing back in and not keep thinning because of this product. Very UPSET! Wish I had known would have never ever used there products.

  4. Kristina Young says:

I have been using OGX Biotin and Collagen shampoo for about a year and have been having extreme hair loss. I went to the dermatologist last spring and she could not find anything that would cause this. Now that I have read all these comments, I realize it has been my shampoo. I have been deceived by the company and only hope my hair will grow back.

  5. Gigi Sturm says:

I was using one of the OGX shampoos & conditioners for color treated hair. I thought I’d try the Biotin & Collagen products. My hair is short & I have never before experienced hair accumulating in my shower drain. I’ve been losing hair ever since I started using it! My husband was a J & J employee & I have always been loyal to their brands. No more! I’m hoping that since I’ve discontinued using these products my hair will grow back.

  6. Vera says:

I was using ogx biotin and collagen shampoo and last year my hair started falling out. My hair has gotten really thin and bald in some spots. It’s growing back now that I stopped using this shampoo.

  7. Jackie Rebimbas says:

I have been using this shampoo and conditioner for at least a year now. My hair was falling out in clumps in the shower, but I attributed it to postpartum. I just started noticing recently that my hair is really thinning on top and was thinking maybe it was age. Decided to look into it to see if it had anything to do with my shampoo/conditioner and I came across this! Needless to say I’ll be throwing it away.

  8. Laura Graf says:

My hair was looking TERRIBLE! Hairdresser had to do major cut and she told me it was my shampoo doing it. Yep, OGX Moroccan Argan Oil Shampoo and conditioner, I thought it was so healthy sounding. Sorry for using it. Great job J&J. First the baby powder, now this.

  9. CECILIA JACKSON says:

I used this product and noticed clumps of hair out each time I washed and conditioned . Now bald in top and side if head. I have to go to a dermatologist. 😔I used shampoo and conditioner.

  10. Kristine Robins says:

My hair has been falling out in clumps the last year. I stopped using OGX and suddenly after 3 months my hair is growing back and no more thin spots.
