Johnson & Johnson OGX Shampoo class action lawsuit

  • The class action lawsuit seeks to represent consumers who purchased various OGX hair products, including OGX Biotin+ Collagen Shampoo or Conditioner, OGX Renewing Argan Oil of Morocco Shampoo or Conditioner, Extra Strength Hydrate & Repair and Argan Oil of Morocco Shampoo or Conditioner, OGX Ever Straightening and Brazilian Keratin Therapy Shampoo or Conditioner, OGX Quenching + Coconut Curls Shampoo or Conditioner, along with others. 

The OGX-brand shampoos and conditioners marketed by Johnson & Johnson to nourish and smooth your hair actually contain a combination of ingredients that cause significant hair loss, a new nationwide class action lawsuit alleges.

Plaintiff Larissa Whipple filed the class action lawsuit against Johnson & Johnson Consumer Inc. Monday in an Illinois federal court, alleging violations of state and federal laws.

Whipple says she bought OGX shampoo and conditioner because of Johnson & Johnson’s “false representation” that they would smooth, nourish, soften, repair, and revive her hair. 

What wasn’t disclosed is that OGX hair products also include an ingredient or combination of ingredients that causes significant hair loss and scalp irritation upon proper application, she says.

“At least one ingredient in the Products, DMDM hydantoin, is a formaldehyde donor known to slowly leach formaldehyde when coming into contact with water,” Whipple says.

“Formaldehyde is a well-known human carcinogen that can cause cancer and other harmful reactions when absorbed into skin.”

The OGX products class action lawsuit says DMDM hydantoin has been used as a preservative in Johnson & Johnson products for well over a decade. However, it says the use of DMDM hydantoin as a preservative creates an unnecessary risk, because safer natural alternatives exist. 

“As such, the Products are rendered dangerous and unsafe for sale as over-the-counter hair smoothing shampoo products,” says the OGX shampoo lawsuit. 

Whipple says Johnson & Johnson failed to properly warn consumers of the dangers associated with using such a strong ingredient on their hair and scalp, even though it knew the risks.

“Defendant continued to conceal the dangers of the Products by failing to appropriately and fully recall the Products, by continuing to claim the Products were safe when properly applied, and by failing to warn consumers of the dangers attendant to the Products’ use,” alleges the OGX shampoo class action.

The plaintiff says, instead, Johnson & Johnson says OGX hair products contain special formulas intended to nourish and revive damaged or dry hair. She says she and thousands of other customers have experienced hair loss and scalp irritation as a result of the false misrepresentations.

Whipple is seeking to represent anyone in the United States who bought OGX shampoo and conditioner products, plus a consumer fraud multistate subclass and an Illinois Subclass.

She is suing for violation of state consumer fraud acts, Illinois consumer laws and unjust enrichment and seeking certification of the class action, damages, restitution, an injunction, a recall of all the OGX hair products and a jury trial. 

American multinational corporation Johnson and Johnson is a household name, known for developing numerous consumer products, medical devices and pharmaceutical items that frequent the shelves of department stores. Many of the company’s products have been reported by consumers as being faulty or hazardous, leading to a range of class actions lawsuits being filed.

Johnson and Johnson is not the only company who has been targeted with such class action lawsuits. In June, a Unilever class action lawsuit was filed for similar hazardous products issues with its Suave haircare products. A class action lawsuit was also filed against Mane ‘n Tail products for ingredients which allegedly led to scalp irritation and other problems.

    I used their products at the advise of my hairdresser due to their claim to repair, hydrate etc. I have lost probably half my hair. I pick up hair from my white floors all day long. The dog eats them. Its all just a mess!

    My daughter (5) was using the Ogx shampoo and ended up having to be seen by a dermatologist and on oral medicine for 8 weeks due to the amount of hair thinning/loss she was having!! I’ve been looking somewhere to file a claim forever!!

    Yes I also used these ogx products and my hair has been a disaster, falling out. Scalp sores. And health problems. I know that Johnson & Johnson should be sued and shut down. There products have been making men weak and killing people since we were babies. Didn’t we learn about the poison jabs!!! Weak men cannot fight against tyranny. Let’s stand up for something, or we will fall for everything.

      My daughter (5) was using the Ogx shampoo and ended up having to be seen by a dermatologist and on oral medicine for 8 weeks due to the amount of hair thinning/loss she was having!! I’ve been looking somewhere to file a claim forever!!

    For the past couple years I used the Extra Penetrating Moroccan Oil. A few months ago I began noticing my hairbrush was getting full of my long hair way more than usual but I just contributed it to aging. Then over the next couple months I realized how much my hair was really falling out. Not only was my brush loaded, but I was finding hair all over my clothes, my furniture, and the vacuum cleaner was loaded. Not only was my hair falling out, but the hair on the top of my head began getting sensitive to brushing and to just pushing down on it. That’s when I decided to research online to see if anyone else was experiencing a problem with OGX products and now, because of what I read, I stopped using this product a couple weeks ago. My hair brush is showing hair loss still but it seems to have slowed down some. The sensitivity on the top of my head has eased up some too. I’m now hoping my hair grows back. I lost about half my volume… And I threw my 3 remaining brand new unopened boxes in the garbage.

    I have talked to my rheumatologist about changing my medication thinking it was causing my hair loss. I was getting very depressed because this medication was the first one that was actually helping me. Now I find out it’s actually my shampoo and conditioner! Johnson and Johnson could have seriously harmed my health if I would have switched. They should have pulled the products or said something. I have been so stressed out about changing medication which is no small thing for me.

    I have been using OGX Biotin and Collagen shampoo and conditioner for a long time as well and have noticed thinning hair and scalp irritation as well – I have been freaking out about it and had no idea these products could be the problem! I was going to buy more tomorrow but will never buy them again! Please contact me!

    I have been using the Biotin and Collagen shampoo and conditioner. I have seen a significant amount of hair falling out and just breaking off. My hair was already super thin and now it’s even worse.

    Yes I have been using this product and my hair is thinning and I was sort of freaking out about it my sister asked what I was using and I told her she said it has been on the news how it is making people’s hair fall out. It upsets me cause it is still on the shelves at the stores and it needs to be taken off

    Yes I have been using this product about a year and a half, I use the extra strength and volume. My daughter who lives far away told me to stop using it because of the way my hair keeps falling out and it’s almost like shedding like a pet. When I shower I always have to remove the hair from the drain. My hair was always been baby fine and always had a lot of it. Now it is so thin and nothing to it. Anyway she told me to stop using it for those reasons and informed me about OGX problems in which I was not aware of, it all makes sense now. I’m an 68 yrs old and thought it was just a part of getting older, I have developed a bald spot also. I guess I won’t be using this any longer.
