A Maryland husband and wife recently filed a talcum powder cancer lawsuit against cosmetics giant Revlon, alleging the wife developed mesothelioma caused by exposure to asbestos in the company’s talc powder products.

The plaintiffs, Laura and Edward M., say that Laura was exposed to asbestos from Revlon’s talcum powder products because of her father’s work for Revlon, when he would bring these products home for her throughout her life.

Unfortunately, Laura was diagnosed with mesothelioma cancer in January 2020, the lawsuit alleges. Mesothelioma is a type of cancer that affects the thin tissue covering the internal organs, known as the mesothelium. Mesothelioma is both aggressive and deadly, and while treatment is available, it often cannot be cured.

According to the lawsuit, which also names Whittaker Clark & Daniels Inc., the companies had access to a plethora of data since the 1930s clearly establishing asbestos and asbestos-containing products as dangerous, yet failed to warn consumers about the risks associated with their asbestos-containing talc products. Many do not realize that talc and asbestos are both mined, often near one another, leading to talc contamination.

“Defendants were members of organizations like the National Safety Council which widely disseminated information about asbestos disease to its members, beginning in the 1930s,” Laura claimed in her talcum powder cancer lawsuit. “The defendants have since the 1930s had numerous workers’ compensation claims filed against them in this state and many other states by employees or former employees alleging asbestos related pneumoconiosis.”

Through the talcum powder cancer lawsuit, Laura seeks $20 million in compensatory damages, along with $40 million in punitive damages. Her husband Edward, who filed alongside her, is seeking $5 million in damages for loss of companionship and mental anguish.

Baby Powder Litigation

So far, similar talcum powder cancer litigation has primarily been leveled against pharmaceutical giant Johnson & Johnson, especially for its baby powder products. Johnson & Johnson has faced thousands of lawsuits pertaining to ovarian cancer from their products, or others like this one over asbestos exposure from its talc-based baby powder and Shower-to-Shower products.

Johnson & Johnson claimed that their products were safe, but also issued a voluntary recall of thousands of bottles of its baby powder back in 2019 over asbestos contamination concerns, undermining the statement.
