Devacurl Hair Loss Settlement Overview:

  • Who: Consumers say DevCurl hair products caused scalp irritation, hair loss, and other damage despite claims the line was more gentle than competitors. 
  • Why: A $5.2 million class action settlement has been submitted for preliminary approval, potentially leading to Class Member awards between $20 and $19,000.
  • Where: The settlement agreement covering a nationwide Class of consumers has been submitted in New York federal court.

The plaintiffs in several class action lawsuits alleging DevaCurl products caused hair loss and scalp irritation filed documents asking a New York judge to approve a proposed $5.2 million settlement featuring $20 rebates and up to $19,000 awards for Class Members Monday.  

A motion for preliminary approval of the DevaCurl hair loss class action settlement stated that the deal “provides excellent relief for the Settlement Class Members.” If approved, Class Members will be able to make either or both of the following claims:  

  • A $20 class action rebate for minor personal injuries suffered as a result of DevaCurl hair products 
  • Up to $19,000 in reimbursements for documented injuries, emotional distress, and provable expenses for adverse reactions to DevaCurl products.  

Class Members include consumers nationwide who purchased or used DevaCurl hair products in the United States between Feb 8, 2008 and thirty days after the date that the class action settlement agreement is approved. 

The estimated number of Class Members is more than 665,000, according to court documents.  

Claims will be able to be filed either online on the yet to be posted settlement website or by mail.  

In addition to paying $5.2 million, Deva Concepts, the maker of DevaCurl products, has agreed to certain labeling changes under the terms of the settlement agreement.  

“Plaintiffs have negotiated a fair, adequate, and reasonable Settlement that guarantees 

Settlement Class Members significant relief,” says the motion for preliminary approval of the DevaCurl hair loss class action settlement.

DevaCurl Hair Loss Complaints Mount 

Deva Concepts was hit with a rash of class action lawsuits filed by consumers claiming they paid a premium for DevaCurl hair products based on representations that the products are less harsh than other products available on the market. Instead, the plaintiffs say that they suffered shedding and hair loss due to harsh ingredients Deva Concepts hid from consumers.  

The proposed $5.2 million class action settlement is not the only legal matter pending against Deva Concepts. A class action lawsuit was filed in Canada last year alleging similar DevaCurl hair loss claims.  

The company also faces angry customers who have taken to social media to complain about DevaCurl hair loss including a Facebook group that reports more than 50,000 members. On Instagram, a search for #RecallDevaCurl reveals more than a thousand posts from consumers urging Deva Concepts to recall the product. 

DevaCurl products are not the only hair care line  linked to scalp irritation and severe side effects. Class action lawsuits claiming side effects from Suave Professionals shampoo and conditioner, Selsun Blue anti-dandruff shampoo, and TRESemmé keratin shampoo and conditioner have all been filed by consumers in recent months.

    Why am I just now finding out about this? I’ve been using devacurl for years! I just spent $174 on products last week. I’ve always lost hair while using the product but I figured it was from stress. I’m so upset. Why have they been able to keep selling?
