The families of children who developed broken bones and skeletal problems after using Neocate formula may be eligible to file a Neocate lawsuit.
Neocate baby formula is sold by the global company Groupe Danone and marketed in the United States by Nutricia US. Neocate products are commonly given to children with allergies or intolerances that prevent them from using formulas with milk or soy.
Neocate products are recommended for these children because the proteins are broken down into amino acids to avoid any intolerance. The hypoallergenic formula has been highly successful and made over $28 million during 2017. However, this success may have been earned at the expense of children’s health.
As early as 2016, Nutricia allegedly learned that their products were associated with skeletal issues such as broken bones and rickets.
A study conducted by the Mayo Clinic and Yale University was published in the journal Bone in 2017. The study showed that Neocate was associated with hypophosphatemia, a condition involving low phosphate levels in the blood.
Although most people associate calcium with healthy bones, phosphate also plays an important role in bone health, bone density, and the prevention of bone injuries. Hypophosphatemia can reportedly result in low bone density, leading to skeletal problems such as rickets (condition involving soft bones), skeletal deformities, stunted growth, and broken bones.
The study reported in Bone examined data from 51 children in North America and Ireland who were fed Neocate formula. Of the 51 cases, 94 percent reportedly experienced rickets, broken bones, or low phosphate levels. However, the researchers noted that “most all improved with the addition of supplemental phosphate or change to a different formula.”
Despite being aware of the scientific evidence, Nutricia may have failed to adequately warn consumers that their Neocate formula products were linked to skeletal issues including rickets and broken bones. Instead of warning doctors and consumers, the company allegedly created a panel of experts to investigate the matter and develop safer products.
Although the new products may help prevent the low phosphorus levels seen in the Bone study, some consumers argue that Nutricia should have informed their consumers of the risks associated with their products instead of keeping the issue quiet.
Now that the word is out regarding Neocate and bone problems, many parents are expressing their outrage. Consumers claim that they were not properly warned about the risks associated with Neocate formulas and could not make an informed choice about which formula to use.
Formulas make up a significant amount of some children’s diets, meaning that the choice of formula can have significant effects on their health. Some of these consumers, alarmed that they were not able to protect their children from bone complications, may seek compensation from Nutricia through a Neocate lawsuit.
