volkswagen VW logo on carA class action lawsuit has been filed against Volkswagen alleging that the car company did not disclose that its 2019 VW Jetta has a defective transmission.

Plaintiffs Dominique Parrish and Evan Wood claim that even though the vehicle has been touted at auto shows as a vehicle that “will make a huge splash in the compact sedan market when it goes on sale,” the cars “have proven to be unreliable, far from an efficiently running vehicle, and a safety hazard to its drivers and others.”

The VW class action states that if the plaintiffs had known about the transmission defect, they may not have purchased the vehicles or would have paid less for them. The plaintiffs state that they now have to pay more money to fix the transmission defect.

The Volkswagen transmission class action lawsuit alleges that the transmission is faulty which results in “catastrophic failure” from the torque converter.

The plaintiffs state that Volkswagen took many steps to try to conceal the defective transmission from the public, turning instead to “Technical Tips,” which were sent to its repair facilities. These tips, allege the VW lawsuit, confirmed Volkswagen’s knowledge of the transmission defect.

The Volkswagen class action complaint also refers to other ways in which VW was aware of the defects, but failed to act on the knowledge.

“VWGoA was sufficiently aware of the Transmission Defect from pre-production testing, design failure mode analysis, calls to its customer service hotline, and customer complaints made to dealers,” the VW transmission class action states.

“However, this knowledge and information was exclusively in the possession of VWGoA and its network of dealers and, therefore, unavailable to consumers.”

The plaintiffs also note that the defect can, “impair any driver’s ability to control his or her vehicle and greatly increase the risk of collision,” which makes the defect a very serious issue.

The VW class action lawsuit states that both plaintiffs performed extensive online research before deciding to buy the 2019 Volkswagen Jetta.

The plaintiffs allege that since the Jetta was released, “the Defective Transmission has been inundated with many customers complaints of grating, scuffing, scraping, grinding, and cracking seals resulting in oil leaks.”

The Volkswagen class action alleges violations of many California laws, including the Consumers Legal Remedies Act, Unfair Competition Law, and Breach of Implied Warranty pursuant to Song-Beverly Consumer Warranty Act.

The VW transmission lawsuit also points to numerous comments and complaints that were made on the National Highway Traffic Safety Administration website.

“In addition to sudden transmission failures, the Transmission Defect presents a further safety concern because it causes the driver to lose all transmission inputs, including acceleration,” the plaintiffs claim.

The VW class action suit also states that “Automakers have a legal obligation to identify and report emerging safety-related defects to NHTSA under the Early Warning Report requirements.”

“Similarly, automakers monitor NHTSA databases for consumer complaints regarding their automobiles as part of their ongoing obligation to identify potential defects in their vehicles, including those which are safety-related,” the Volkswagen class action complaint states.

The plaintiffs allege in the VW class action lawsuit that Volkswagen should have seen all of the complaints that were filed with the NHTSA, which would have notified them of the transmission defect.

    I have the same problem with my vw but mine is a 2012 vw Jetta tdi I haven’t even had it for two years yet or even got it smogged yet and it’s been giving me problem from day one the extended warranty said it fixed everything on it brand new everything and my car is disabled siting at the Volkswagen dealership and it’s going to cost 11000 to fix it. It started off with the car making this humming noice underneath the engine to having the car not go when pushing on the gas and the car won’t go past 20 miles per hr

    Just purchased a 2019 VW Jetta from CarMax, less than 30 days ago. Week two of owning it, I had already taken back to CarMax to get a grinding noise looked at. They stated “it’s a characteristic noise that the car makes when shifting at lower speeds.” They recommend taking it to VW to get a second opinion.
    Which I did, they said that I need to expect to keep it with them for at least two weeks, just to get it looked at, and that if it needed a part it would take longer because parts aren’t getting shipped in from Germany as quickly.
    I feel like I got scammed, what do I do? This is my only car, I haven’t even started making car payments on it yet…..
    Same grinding noise that everyone else is complaining about!!

    My 19 Jetta makes the same noise. The original transmission was replaced in May 2021. The new transmission makes the same noise which indicates that it will probably eventually fail as well. Like the car, but what happens when the warranty expires?

    19 jetta also. Grinding tranny, using oil, and a bevy of sensor and switch errors randomly. Last vw i ever buy.

    My son and I purchased a VW Jetta in 2017 and it has had continuous problems. It is now at Car Max, the dealer. Not drivable. I have had enough of their mess. I wrote a mail letter to them on February 1 ,2021 but no response to the email letter. I don’t want to pay on this car any longer because it has been a problem form day one. Need some advise. Why anyone would pay for a car that is undrivable. If you respond to this email I will forward my email letter to you.

      I have the same issue with my brand new 2019Jetta. I brought it back to the dealer and was told VW knows about the issue and they are currently working on a computer update that will fix the problem. The funny thing is he said to could take weeks or months to resolve. Now it looks like he was just placating me so I wouldn’t complain further. Any idea how I become part of the lawsuit?

    My 2019 Jetta “growls” at 30 mph. Apparently this is a wide spread problem that dealerships “are aware of”. That is not comforting!

    I bought my Jetta November 7th, 2019 and it’s been grinding since day one. Didnt notice it during the test drive with the salesman talking and “explaining” the cars features. Brought it up to my dealer and they keep telling me that its “normal” and that it will “take a while to break in”.

    Dec 26 2019 purchased a grinding jetta new. Dealer will not fix nor refund.

      I purchased mine in Dec 2019 too and it’s doing the same thing. Was told at the service dept they knew of the problem and many had complained but nothing they could do until a recall. If I had known. I would have never purchased the vehicle. It’s unethical.
