New and used vehicle owners may be able to recover monetary compensation through the Kentucky lemon law if their cars are plagued by a substantial defect.

What is a lemon law?

If a vehicle has a serious defect which impairs its use, value, or safety, this vehicle may be a “lemon.” To save customers from being left with defecting or worthless vehicles, many states have lemon laws.

Although each lemon law varies, many laws allow consumers to seek repairs for free, have their vehicle replaced, or even receive a refund for the vehicle’s full purchase price.

What is the Kentucky lemon law?

Kentucky’s lemon law covers only new vehicles which were purchased within the state. Other states, such as Colorado and Washington are similar, in that no used vehicles are c0overed by the law. The law in Kentucky also excludes motor homes, motorcycles, mopeds, farming tractors, and vehicles with more than two axles. Vehicles which have been heavily altered since purchase are similarly excluded by the law.

The Kentucky lemon law considers a vehicle to be a “lemon” if the customer has to bring their car in for repairs for the same defect at least four times or if repairs cause the vehicle to be out of service for more than 30 days in total. These situations must occur within the first 12 months or 12,000 miles of a vehicle’s ownership.

Can I take legal action under Kentucky’s lemon law?

If your vehicle meets the eligibility requirements for Kentucky’s lemon law, you may be eligible to take action. This can include seeking repairs, participating in a manufacturer arbitration process, or even filing a lawsuit should the manufacturer refuse to comply with Kentucky lemon law requirements.

loan from Western Sky or CashCallTo start the process, consumers should notify the manufacturer of the issue in writing. This gives the company the opportunity to fix the problem. If the defect cannot be repaired, manufacturers must provide a replacement or refund.

Typically, disputes are resolved through a manufacturer’s arbitration process. These systems are governed by Kentucky laws. Arbitration complaints need to be filed within the first two years of a purchase and should not cost anything for customers.
