Michael Kors faces a class action lawsuit stating it uses false reference prices when advertising discounted items at its outlet store.

The company presents sale prices and signage but does not indicate that the prices are not former prices, recently or regularly offered prices or the prices, which identical products are sold, according to the Michael Kors class action.

Plaintiffs Demetra Binder, Angela Waldner and Jennifer McCall filed the class action lawsuit in United States District Court in the Southern District of New York asking for monetary damages, restitution and declaratory and injunctive relief.

The Michael Kors false price references violate New York, New Jersey, California and federal law, including the Federal Trade Commission Act, which pertains to “unfair or deceptive acts or practices in or affecting commerce.” 

“Aware of the intertwined connection between consumers’ buying decision processes and price, retailers like defendant lures consumers with advertised discounts that promise huge savings and high value,” the Michael Kors lawsuit states. “But the promised savings are false and the product’s value reflected in its price is incorrect when the retailer inflates its prices due to advertised discounts off of some higher, made up ‘original’ price that no one ever pays.”

Michael Kors outlet prices remained on sale constantly, class action states

Investigations from the plaintiffs’ counsel showed Michael Kors items remained on sale constantly, the class action states. Counsel tracked the prices from March 2021 through June 2021 and then February 2022 through August 2022 and each time the products remained on sale and were compared to reference prices that were never used.

In related news, Wilson Leather faces a class action lawsuit stating the company uses fake reference pricing to lure customers to buy items.
